Mortgage recording error...

Hey B’stoners.  I took out of mortgage with Bank of America ~3 years ago.  I checked the NYC .GOV ACRIS site and noticed that the mortgage was not recorded correctly by the settlement company.  The settlement company sent the wrong address to the city register’s office and now it appears that I have a loan on a house that I don’t own and have no affiliation with at all. I’ve gone back/forth for over a year with the settlement company to correct the error with no results.  I’ve also been trying to get BOA to look into the matter but they’ve essentially told me it’s my problem and I should pay for a title search to see if it causes an error.  Any suggestions on what to do from here?  I don’t think I should need to pay to fix this since the error is clearly on the document that the settlement company sent to the city register’s office.  I’m sure this can be a pretty big deal if the owner of the other home tries to sell his home or needs to take a loan out.  Thoughts? Thank you

The opposite happened to me. I had coop mortgage recorded on my block and lot that was for a building two doors away. I called my lawyer who identified the law firm as a huge real estate closing firm. He advised me to contact them. I did and after months of dealing with the paralegals, I called my own lawyer to tell I was going to report the firm to the bar association. He advised me to send a letter/email threatening to report them to the bar association. Guess what? One of the partners called me and within a week it was taken care. Inform the settlement company and your lawyer and request that this be corrected immediately.

Have you contacted the lawyer who handled the sale for you? Sometimes they are the only ones the banks and other companies respond to.
