Back Yard Cabling / Access / Fence
Our back yard abuts an industrial building’s 2 storey CMU wall. There is a big telephone distrubution box on that wall (12″ w / 24″ t) that is the nexus of a HUGE tangle of wires, etc. Also back there is a ton of caox cabling. We’ve been tracing back and cleaning up all the disusued cabling running to our house in advance of demolishing the exisiting fence and putting up a new one. So, several questions for the collective: – Are we obliged to ‘host’ cabling for our neighboring buildings on our property, ie, our fence? – How do find out which utility company is responsible for what? We’d like to get the mess cleaned up. – Our current fence is about 2′ off of the CMU wall. We’d like to run the new fence right up to the CMU wall. Does BK require access alleys in back? I used to live in a rental that was on a block that is residential on one side and factories on the other and all the fences just ran up to the factory walls, so… – Last, one run of fence is not on the correct property line. It racks in a significant amount on the far side. This run is the only fence between us and that neighbor. We’d like to put it in the correct spot which means recouping some of our yard from the neighbor. We know there is a statute (and we don’t know yet how long our fence has been up – we inherited it with the purchase), but beyond that, any other hints to make it smooth? Thx all.

No, just google it. Adverse possession + new york city. But as I recall, the language was fairly impenetrable. Which is why I talked to lawyers. Real estate lawyers, esp.

Went through something similar. Based on our experience, I suggest you call TW and Verizon and tell them that the wall is coming down and if they don’t do something about the wires, you’re afraid your contractor will cut them. That should get some action. You need to speak to the right-of-way department (or, as they kept calling it, the Right-away department) Re: adverse possession. Particularly under more recent law, just because a fence isn’t on a corrct property line doesn’t mean the other guy gets to keep your property. The newer version of the law is designed to prevent just such “frivolous” lawsuits. This is based on consult with three lawyers, regarding similar situation with out neighbors and our fence. So, get TW and V to remove and relocate their wires, then reconstruct the fence along the correct property line. (I presume you hae a survey.)
