I have been trying to close on my home in Brooklyn for about 13 months now and need some real advice on switching expediters/Filing representative. Some background: After agreeing to sell my home, receiving the earnest money and going to title, the title company kicked it back stating that an easement we had ‘written’ on the deed (legally purchased in 2004), needed to be drawn into the city tax map. (NO ACTUAL CONSTRUCTION) At this point (June 2014), we engaged with an expeditor to work to get the appropriate easement drawn into the tax maps. It’s been a LONG arduous process that honestly is very foreign to me. I’ve paid for architects, drawings, surveys and numerous other things over the past 12 months with no clear understanding of the timelines necessary to complete. At this point, we finally have submitted job numbers in the BIS system but I feel like this has taken an extraordinarily long time to get to this point and have finally reached the point of frustration that I am considering alternative options (i am also fearing losing my buyer who has remained steadfast this entire time). My questions are : 1) Can/should you switch filing representatives in the middle of this type of process? 2) What type of information is necessary to facilitate a switch? 3) could this put the entire process ‘back to the start’ – which has been my fear from the beginning. 4) Could this year timeframe be legitimate for paperwork only processes? Have you contacted the title company that you bought title insurance from in 2004? It sounds like it should have been recorded at that time. Are you using the same Attorney to sell as you did when you bought? You bought title insurance in 2004 to avoid issues like this when you come to selling.
