Settlement offer from Con Ed

I’d thought I’d update the Brownstoner group on our ongoing small claims court case against Con Ed for flooding our basement with a fire hydrant. ( http://brownstoner.staging.wpengine.com/forums/topic/small-claims-court-against-con-edison/) Had a call from them today offering to settle “but not the full amount because……” they feel that the statutory regulations insulate them from claims. I asked for an explanation and he went on to read the statute he thought was applicable (Basically its about electricity supply and if they turn the power off and the food in your freezer spoils you cant sue). I pointed out that this was in relation to supply issues but instead we are claiming property damages. He felt they were one and the same. I then asked him so basically you are saying if you are driving a Coned truck, and you drive into my car……because you are Coned you don’t feel you have to pay the damages…..because you are Coned….. chuckles…..thanks but we’ll pass on your 50% offer and see you in court. Anyone who wants to come along for the laugh is welcome to come along Thursday the 8th of May at 6.30pm

I think you have an excellent chance. It is small claims court. I expect you and the defendant will be offered to wait a long time for a judge, or see a mediator right away. Have I got this right? Most cases are mediated, and the most reasonable side can prevail, not the most greedy or punitive or most restrictive interpreter of law. I am not a lawyer, and to be clear, my business was not sued, but I saw the process a few years back. Will Con Ed make you wait for a judge? Will they show up? It does not seem rational on their part to spend all that money on lawyers, when you only demand the maximum Judge Judy could award. I also learned my business can not sue in small claims court, only I can sue as an individual. Was your personal property damaged, or the property of a corporation? Please let us know how this works out for you.
