Neighboring House Sold to Developer - What now?

We live in the South Slope. The neighboring house – with which we share a party wall – has sold to a developer. Just received a letter that they are submitting a permit for a “partial demolition and / or excavation.” There is significantly more allowable square footage than they currently have. Will this cause any danger to our structure? We are not landmarked – and most houses on block are 3 stories – can they put up a 6 story building if they want?  Is there anything we can / should do? Thanks for everyone’s advice!

Left field comment: have you thought about selling your house to the same developer?  Maybe this would be a way to cash out before the construction begins?

south slope zoning along side streets is R6b or R5b.  A R6B property may be able to build to a max of 50 feet if the lot is wide enough.   Is the lot 24 by 100 by chance?   You can check the department of buildings BIS web page which will show you any and all permits they have pulled as well as zoning and number of families, sq ft planned.  The fact that the builder has sent you a note shows he is playing by the rules… so far.     You will need to document EVERYTHING in photos pre constructuion as well as during.  They will be responsible for waterproofing the exposed side of your building to prevent damage.  Go to the DOB BIS web site… it will be your best source for info.

The developer will more than likely max out per zoining.  As Dave says hire a structural engineer to review what they are doing and keep an eye on your place.  There are ways to make sure your building does not more one milimeter.

Zoning and FAR will determine what thwy can put up.  You need to be concerned with your founfation and party wall with excavation.  Stay on top of this even if you have to hire your own engineer.  Search the MacDonough St stories on the Home Page here.
