Stoop over reaches property line?

Thank you so much for your quick reply, arch_tect!   So, it does date back to before 1938\. However, I’m planning to re-build the stoop so it runs right up to the sidewalk. Are we at risk of losing a $10K investment if the new bottom step over-reaches the current encroachment. I’m trying to correct for 10″ risers, by adding a couple of steps and bringing it right up to the gate — if you can picture that. If we apply to the DOB, any ideas how that would work? (Maybe time for a conversation with Schnall.)

I want to learn how far my stoop can safely over reach the property line on the street side, without running afoul of the law. There are some interesting comments on the forum, http://bit.ly/wdsDyS but I would like to find something more definite.

If it is a pre-existing condition (i.e. dates back before 1938) it can remain at the current encroachment.  If not, the maximum permitted without applying to DOT for permission is 18″ past the property line.
