Disabled access to new roof deck

Not sure if the above posts actual;y answer your question but, your last sentence may be the more relevant one in that they might sue anyway because of the use of shareholder funds. This is, afterall, New York where people sue over anything. If that’s the case, perhaps explore how many units would actually want it and assess them separately for the construction. It’d have to be written into the bylaws frrom here on as to which units have access based on assessments. Not sure if something like that could be done.

My building, a 1930s, 20 story elevator co-op in Manhattan wants to create a public garden / deck on the roof. There is only one set of stairs leading to the roof, up two flights. We have some mobility impaired shareholder-residents who have questioned whether or not the new roof deck will be ADA compliant. The Board’s position is that the ADA compliance is not required. Does anyone have any input on this? I’m concerned we’re going to be hit with a lawsuit if shareholders’ money is spent on a facility that some shareholders won’t be able to use.

I think your concerns are valid. Why not make it accessible? Maybe a chair lift up the flight of stairs?

To meet ADA compliance you would need a wheelchair stair lift. A chairlift by itself may meet the needs of some mobility impaired persons but would not be adequate for persons confined to wheelchairs
