as-built drawings for Certificate of Occupancy conversion
I’m changing the Certificate of Occupancy on my brownstone from a 1-family to a 2-family. As we are preparing the as-built drawings, we have discovered that some of the measurements of existing conditions in our approved plans are incorrect. Should we correct them for the as-builts or leave them and make the changes fit the incorrect drawings? We have extended a closet 2 feet into a hallway to make room for a washer-dryer. The closet extends towards the top of the stairs to the basement. In the approved drawings, the stairs are about 2 feet off which makes it look like the landing at the top of the stairs is not large enough to meet the code. In reality the landing is plenty big. This has been such a long process that I hesitate to open a new can of worms with the DOB – we’d have to move the stairs location on all floors in the drawing to correct the error. Does the DOB inspector take measurements to verify the existing conditions? Any advice would be appreciated. This is our architects first job so she isn’t super familiar with the process.

I think I would wait to see if any more issues come up during the inspection before submitting an amendment.

Thank you a2chitect. We are confident that the as-built condition is code compliant. Would it make sense to submit the amendment before the the inspection? Or is it better to wait until after inspection in case we need to make more changes?

I would actually be more concerned about the washer-dryer in that if you did not show this on the approved plans, it will be a problem. If it was on the approved plans, and you just had to enlarge the closet a bit more, then it may be okay. If your stairs are compliant, then I doubt the inspector will scrutinize them. He/she may request that the plans be amended to show the current condition. You probably won’t fail the inspection but rather the DOB won’t fully sign off until the plans are amended. This just becomes a paperwork/drawing issue. If you address these types of inspection comments directly, it shouldn’t open up any other issues. I would just wait to see what the inspector flags…or not. That assumes your architect is confident that the as-built condition is code compliant. If not, then that is a different matter altogether.
