Revocable Consent - Expeditor or Architect needed
The term “revocable consent” means that the DOT (Department of Transportation) is granting the property owner permission to build something on the DOT’s property, and that this permission can be revoked at any time the DOT sees fit. In fact, the applicant must give the DOT a deposit equal to the amount of removal of the item, should the DOT decide to revoke their consent and remove it. We’re going through a DOT revocable consent application right now to re-create a stoop that was removed prior to the 40’s tax photo, so we’re applying as if it were new. The people at the DOT have been very helpful in making sure all of the information is on the application in the best way to make the case. You actually go through a preliminary round where staffers comment on the application until they think it’s good enough to be reviewed by those at the DOT who will make the decision. In that respect it almost exactly like going through a LPC commission review, which we also did for this project.

Hi, I need the most cost-effective way to get a revocable consent so I can put a fence on the sidewalk in front of my condo. The process call for plans sealed by an engineer or architect. I have been saving to get this started and need to find who can help get this done without making it cost prohibitive. Please let me know if you know of anyone you can recommend. Thanks

I Dont understand…if it is a revocable consent it implies to me that you have consent of property owner to place a fence. Then put the fence up until the consent is revoked. It may just be that i don’t know what you mean by ‘revocable consent’ If you do need ‘plans’ and ‘stamp’ (as part of what the owner requires dor consent) then you need an Architect or PE. He/she will hire a surveryor (well, you will pay for it), you will install the fence, and the architect will ‘certify’ that the fence was installed and the survey reflects the location, etc.

Revocable Consent is required because your proposed fence lies outside of your property lines thus placing it in DOT’s jurisdiction. If you can prove that a fence existed when the building was originally built, you MIGHT be able to get the revocable consent waived. You will need to obtain a Tax Lot photo between 1939 and 1941 to see if a fence existed. Hope this is helpful. ARCHITECT-A2 PLLC www.architect-a2.com
