former 2 family with english basement

1-confirm that lower level is a basement and not a Cellar 2-confirm whether it’s a 1 or a 2 family dwelling. Without a CO use letter of no objection process. 3-if it’s a 1 family and floor is a basement you can convert to 2 family. You will need to hire an architect. 4-you can do what’s called a block & lot search at DOB – this will bring up all files Thats available for building. I think it’s done on Tuesdays at Brooklyn DOB

We are looking to buy a 1901 brick building that is listed as a B1-2 family by DOF (no CofO) in Broklyn.  The current configuration is an owners duplex on the parlor and top floor with an English Basement (seperate enterance, more than 1/2 above grade, 2 points of egress and ceilings over 7 feet) w a full kitchen and full bath.  The current owner’s are renting the space to their brother.  The bedroom is windowless. My first question is if we can I get a mortgage if the basement is set up as an apartment , my 2nd question is assuming the apartment is not legal, iwhat does it take to legalize an apartment in the basement if we made it a studio so the sleeping area has a window and my 3rd question is how do I look at the  file at DOB so I can see the history.  There is a record in BIS of a job in 2001 to remove the underground oil tank and install a hot water heater so it seems like DOB might have more info on the property than what is online.  Thanks!

1\.  You would need to check with your bank to see if they will accept a letter of no objection in lieu of a Certificate of Occupancy.  Nearly everyone does.   2\.  It’s hard to determine whether the space could be “legalized” without seeing the plans.  If it involves tearing down or putting up a wall you’ll need to hire an architect or professional engineer to draw plans, and then seek a permit from the DOB for the work.

3\.  You would need to go down to the DOB to pull the job folder.  You can do it yourself (get a ticket, fill out a form, wait to see the guy at the window, give them your ID, wait for the folder, review the folder, get another ticket, turn it in, etc),  Or you can hire an expeditor to pull it and get you a copy of the contents.
