Evacuated from apartment

We live in Carroll Gardens on the 4th floor of a nice rental building.  We love our apartment.  A few months ago we noticed that most of the stairways in the building were getting progressively worse.  Finally the DOB was notified and put a notice on the door that the stairs had to be fixed by a certain date.  Our landloard called his cousin and they startred the work, without a permit. Long story short- the stairs they were putting in didn’t look that great or safe and the DOB was called again. This time they came back, posted a stop work order and told me and the couple above me that we had to vacate our apartments.   What responsibility does my landlord have to us to cover the expenses we are incurring while we are out of our apartment? He’s mentioned reimbursing us for the nights when we are out of our place but there is no way we can find somewhere to stay that is comperable to that cost. Most places are nearly $200/night ($6000/month!) and our rent is less than half of that. This looks to be quite expensive, not to mention having to haul or belongings with us to work each time we have to check out of oine place and into another.  Any advice? Will I ultimately get stuck with the bill?  We have renters insurance but it doesn’t cover this expense becasue this isn’t a normal “occurance” such as a fire or earthquake, etc.

I feel for you. I was in a similar situation but, in my case, the emergency vacate order was the result a surprise visit by the FDNY and my landlord was mortified (she also lived in the building).  She paid for the tenants’ hotels for 3 nights and also took those 3 days off of our rent.  I would think that HPD would be the best resource to find out what your landlord has to do for you now, legally and financially.  Good luck.

You should just sublet someplace for a few weeks.  I have a 2 bedroom in Red Hook that I am subletting from this Saturday (8/18 until 9/2). Unless you and the other tenants force him to pay, yes, it is likely that you will get stuck with the bill. he is not likely going to offer this. When vacates like this occur, there are usually two likely housing routes – 1) the landlord/owner puts you up somewhere unitl DOB lifts the vacate or 2) you are given two nights in a hotel by the Red Cross, and then, I believe HPD gives you a place to stay until the DOB lifts its vacate. If neither of these two scenarios occurs, then you need to work through the DOB (or HPD) to find out what you need to do to force this guy to give you satisfaction.
