changing windows in extension?
We are in Park Slope landmark territory. We have an extension for which we’d like to change the windows and doors. Specifically we want to close up a door to the yard and replace two small windows with larger ones (it used to be the kitchen and is now a den but the openings are all in weird places to accommodate appliances etc…). Ideally we would turn one of the windows into a bay window, the other just a much bigger window. We are on excellent terms with our neighbors that face the potential bay. The neighbors on the other side are never there. Across the yard, on the other side of our fence, is a small apartment building. Here’s my question: do I absolutely have to get a permit? Has anyone done work like this without one? And does it have to go through landmarks even though it’s in the back? Thanks!

Just note that the DoB fines for work without a permit are $5,000. That being said, a friend of mine in Ditmas Park did a tiny addition to the back of his house. The house had a little pantry bump out in the middle of the back wall. He want to extend the bump to the side wall on one side. He ended up building the addition in his garage and propping it into place one evening. Never caused him any problems and he got two extra windows and a much better proportioned kitchen. He later sold the house, again no problems…

This probably is not the best forum to ask “do I need a permit.” But in this case, you can get away with doing it quietly without filing. Your assessment that no one will care is probably correct. And since this is an extension, the structural issues are really quite minor. As always, be discrete, don’t leave a lot debris outside, do it over a weekend, and, most importantly, do it right, i.e exceed the code on things like your headers etc. And make sure you have all of your materials before you start the job – don’t get stuck with an open wall for any length of time.

Yes, window replacement even in the back requires a permit from the LPC. Moreover, the work you describe requires a permit from the DOB (making larger window openings is a structural change to the wall) and the DOB will absoultely need the LPC permit.

Yes you’ll need to file with landlmarks and for a permit. Landmarks will review any work being done in an historic district. If it doesn’t affect the facade or street views, they will issue a certificate of no affect.
