Certificate of Non Harassment Background check. They contacted one of our relatives!

It was my understanding that the inquiry period for a Certificate of Non Harassment is three years from the date of your filing the application.  A week or so ago an inspector from HPD visited because we have filed for a Certificate of Non Harassment.  Yesterday, my mother in law called us saying HPD had sent her a letter wanting to know if we had cut off services or harassed her in any way.  My mother in law who over TEN YEARS AGO had BRIEFLY used our address to receive mail!  Is HPD going to try to find every single tenant that ever lived in our home?  EVERY SINGLE ONE no matter how long ago?  Does HPD follow their own rules?  Are there any real rules or does the city just do whatever they want? Seems like they are just looking for an excuse not to give us the certificate.

I am considering submitting a request for a CoNH and notice on the form it asks why you want the certificate. Anyone who has an SRO knows there is value in this piece of paper, but do you have to be careful in how you answer this point? For example, if you say the reason is to change the C of O, could they request architect plans etc?

Ferney1c,  I don’t think there are any secrets. Do youself a favor and call the non-harrasment unit. It will take many attempts. Leave them messages and call every day during their telephone hours (I think just the morning). In my experience they’ve very helpful on the phone when you can actually get them. I think that if you treat them with respect you’ll be pleasantly surprised.  In my experience there were some tenants that were just bad tenants, but they were not a problem with HPD. There were, however, elderly people without the mental and financial means to relocate, and they were a case study for the necessity for these kinds of pilicies. I have heard horror stories, but I feel that in our case it was a total win for the sellers, the tenants and us. Try not to get too stressed, and manage your expectations. Don’t expect anything within 6 months-that’s what I’ve always heard.

In our case we were told HPD was about to issue the Non Harassment letter after they had not received any responses to the letters they had sent out. When it failed to appear, we called back and were then told that they had decided to send an inspector out on foot to try to knock on all the doors of the former tenants. Totally insane. Meanwhile you are paying your mortgage and unable to do anything.

I own an SRO, and have a CNH. You can call the Department of Housing Preservation and Development – Non Harrasment Unit and ask questions. This is not a fast or easy process, but I don’t think that people give them as much credit as they deserve. Unless you have a previous tenant that you’re worried about I don’t think you have anything to worry about. If they find anyone that wants to be a pain, they’re going to get them Legal Aid, and a Legal Aid attorney is not going to waste time representing a client without a case.
