Can I build a water wall/fall in my below grade garden?

Those are tricky questions (for me, at least). If you have an existing hose bib in the rear yard, and can connect the water feature to that, so that you can disconnect the whole thing manually, then I don’t think the fountain would be any different than a hose with a sprinkler.  If you’re running new piping out from the building, I think you’d have to file, but may just need a plumber to file directly, w/out any need for an architect/engineer. I don’t know about the trees, I don’t believe you need a permit, but in the name of being a good neighbor, I’d stick to trees that wouldn’t grow to be more than 20′ high, so you won’t block their view, and block most of the sunlight that makes it down to your yard. Consider how you’re getting that/those trees into your yard.  If they’re very small, you can bring them through your apartment…if they’re large, unless you have easy access from the rear/sides, you’re talking about craning them over the building. I live in a 2 story condo (new development) that is below grade. Both levels are livable space. I have a garden that is 20 feet below the backyard ground level. I would like to do some landscaping to make the space more interesting. I  am trying to find if there is any restrictions on what can I build, can I plant trees? I would really like to build a water wall on a portion of the walls that surround the garden but can’t find any info, can anyone help?

Yes, you can plant trees, or just about anything you want…but make sure you’re planting species that will thrive in the available light and water (you could add a irrigation system if needed/wanted).  You can have a water element too, but these need to be properly designed, drained in the winter, etc.  As long as the water is in motion, and  not stagnant, mosquitoes should not be an issue.
