Another no C of O post

Don’t bother with the I-card. I’cards were only given to 3-families and up. However, the HPD website will list the number of dwelling units, and in cases with no C of O, that’s what the DOB will refer to.

Hello! I’m in contract to purchase a Victorian house in Queens. It has no C of O as it was built in approx 1905, title search did not turn up a CO, DOB has no CO on file. The house is designated as a 1-family house (A1) by the tax department. I would like to convert it to a 2-family house. There was a kitchen on the 2nd floor and when I went to DOB I found alteration paperwork from 1936 that states this house is a 2-family house. Do I have enough grounds for filing a Letter of No Objection? It seems to me that LNO would be a more time-efficient route to start using the house as a 2-faily. Will I be able to legally rent the 2nd floor without obtaining a new C of O? Any advice would be appreciated. Thanks!

You don’t necessarily need a C of O for it to be a legal two-family. Not sure the tax designation matters.

If you can get a letter of no objection it is the best way to go, because the new building codes for getting a new C of O for a frame house as a two family are onerous and the new tax re-assessment will knock your socks off a couple years after you have finished. The current tax class has nothing to do with legal use, unless you can find all the historic records for when it started being taxed as a two family. In which case you should include all of that in your file for the letter of no objection. The more historic records you have, the better showing that it was a two family prior to C of O’s coming in in the 1930’s. I recently included a for sale advertisement for a house I was working on in the Brooklyn Eagle published in 1929, I can’t say that alone worked, but I am sure all the records I got from many directions pushed it through. But that was Brooklyn. I don’t know about researching in Queens.

If you found alteration paperwork in your DOB file, there should have been a permit or index number included on the paperwork. That number will be a key component in your LNO application. Also, you can try an online lookup of your building’s I-card: https://hpdonline.hpdnyc.org/HPDonline/provide_address.aspx I find the link above easier to use with block and lot number, rather than street address. Be sure you show correct borough. You can also access your I-card by going to the HPD website and entering your address at the bottom of the right-hand column where it says “Complaints, Violation & Registration Information”: http://www.nyc.gov/html/hpd/html/home/home.shtml
