On the front we hare definitely over 50% above the curb, in the back more than 50% is underground….. Do I have a cellar or a basement and in case it’s a basement can we put an apartment down there?

Depends on how old the house is, and whether the city has an established curb height. Cellar/basement rule is based on AVERAGE depth below grade. If there is no established curb height on the books (filed in the Borough President’s office), there is a procedure for figuring it out on your own. Measure every 10 feet, where the ground touches the building, and average those measurements.
