Since we last took at look at the Bedford Avenue building boom, several of the buildings have been completed. And it ain’t a pretty picture. Here are five examples between Wallabout Street and Myrtle Avenue.

  1. It seems the answer is complicated- the Hasidic community acts as an FBO to build housing and markets it to that community. However, it is supposed to be illegal to deny housing to someone who is not Hasid. On the other side, people who are not Hasid might not even apply because they would be made to feel uncomfortable.

    I haven’t been able to find out much more than that but it does seem that Bush’s FBO initiatives have made it easier for all religious groups to use their religious rights to practice discrimination. It isn’t just the Hasids, but it does seem to be a practice among fundamentalist religious groups.

    Here’s an answer. First, you are focusing on one constitutional issue – the 14th Amendment protection against discrimination but you are ignoring the 1st Amendment protection for freedom of religion. Moreover, I forget the name of the act, Religion Reformation or something, but Congress passed a law a number of years back saying the government must be be tolerant of religious practices. So there are both constitutional and statutory protections here. A third issue is who built the buildings – the state or a private developer. Granted a private developer is not supposed to discriminate against certain categories of people – but I think a private developer raises fewer issues than if the state built it. Finally, it might also be the case that no one has challenged this practice. Until a person files a lawsuit, the practice can continue even if it’s not legal.

    It does violate housing laws – but the DOH and other gov’t organization turn the other cheek when the hasids break laws, since they have alot of politcal clout.

    remember that warehouse they were using as a school on Kent Avenue that looked like it was ready to fall down/spontaneously combust?

  4. No one is answering my question about how there are buildings built to meet the specific needs of one religious group and how that building is then able to house that one specific group of people without violating housing laws.
