  1. I don’t have much sympathy for those caught, like the recent underwear bomber, trying to do the deed, or caught with obvious terrorist supplies and a map of the subway. Send ’em away. But the problem is that far too many of those in places like Gitmo are there because they are Muslims in the wrong place at the wrong time who have done nothing. The case of the Canadian man who was incarcerated for 6 years for absolutely nothing is an example. After a big stink is made on humanitarian grounds and these people are released, don’t be surprised if they do end up as terrorists, can’t blame them. Obama is right in trying to expedite these cases, and separate the true terrorists from those who got caught in the previous administration’s over zealous attempt to wipe out terrorism. I think Gitmo still has some kid who was 14 when they sent him there, and he’s in his 20’s now. If he wasn’t a terrorist then, he sure probably is now.

  3. dave- if the government considers terrorist to be “soldiers” in a war, a military tribunal is warranted. But read the Atlantic article to understand why some people think a civilian trial gets better results – for us, not the terrorists.

    I totally agree with Dave on this one. And that the underwear bomber should also be treated as a terrorist and tried in a military tribunal. If news reports this past weekend are to be believed, AG Eric Holder made the decision to try terrorists in civilian courts WITHOUT consulting Obama, and the Administration is now trying to walk the decision back. I think it was very smart of Scott Brown to use this in his (winning) campaign.

  5. Both of those bombers were mirandized AFTER they confessed to the FBI. In other words, the FBI already got the information they wanted before telling hthem their rights.

    The big problem with your POW idea dave is that what happens to those innocents who are mistakenly arrested? Because there are quite a few of those and in Guantanamo. Mostly because of mix ups with names. SO what should they do? Leave innocent people here?
