advice re: RPIE non-compliance notice
Yesterday I received a “2012 RPIE non-compliance notice” in the mail for our small coop. I’ve been the treasurer for the coop for over 3 years, and we’ve never gotten any notices about this, and I definitely didn’t get any kind of statement or notice prior the due date of 9/3/2013 telling me that I needed to do this. We are a 5 unit coop with exclusively owner occupied apartments so I am assuming we should be excluded, since we meet this exclusion reason listed in the [RPIE worksheet](http://www.nyc.gov/html/dof/downloads/pdf/rpie/2012_rpie_inst_wkst.pdf “RPIE worksheet”): Section D – 1b: “The property is both exclusively residential and has 10 or fewer apartments. Your count must include all units, whether vacant or occupied.” It does say that if you are exempt from filing, you should file it anyways. There’s no penalty for review this year, but it does say that if you didn’t file on time then you have forfeited your eligibility to review your tax assessment. Did others get this letter? Is it odd that we would get this notice despite always being a building that should have been excluded, and without having received any advance notice that it was required to file?

thanks for the responses. Our property taxes are paid by our mortgage bank, out of the escrow account we pay into with the mortgage on the building, so we don’t get property tax statements. Kinda bs that they don’t send out notices about this.

The City used to send separate notices by mail, but for the past few years they just include a one-line reminder in small type on the quarterly property tax statement due July 1\. The City expects owners to be aware of and abide by various deadlines, regardless of notification. A 5-unit building that might be exempt from filing an RPIE is NOT exempt from filing an RPIE-B (basically the EZ version). Under certain circumstances, once you’ve filed an RPIE-B, you’re sometimes allowed to skip a year or two of filing.

We’re also a small co-op and have gotten the letter several times, including this yesterday. I tried doing the full filing to get our taxes lowered but was unsuccessful. They looked at market value only and said we were at the right level. I now just check the exemption box. I just finished. It took less than 5 minutes.
