Looking for a good landlord/ tenant lawyer for evictions

We are in the process of making an offer to buy a 3-family house in Brooklyn. Currently there are tenants–one is on a lease and a government assistance program; the other two are month-to-month. We are wondering if it’s wise to move forward in purchasing this property w these conditions. What possible problems will we face in evictions etc? We would like to duplex the top two floors and rent out the garden apt at market rate. We need ye advice of a good landlord/tenant lawyer–does anyone have a lawyer or firm they recommend?

I think you are confusing the points here, OP.  When you make your offer, you specify that the property must be delivered vacant.  Presuming seller agrees, that gets written into the contract.  You show up for closing, the property is vacant, you close.  Not vacant, you don’t close.  You only need an attorney experienced in evictions if you intend to purchase the property with tenants in place.   Good luck.

**May landlords evict a Section 8 tenant?**
An owner has the right to begin a non-payment or holdover action against a Section 8 tenant in Housing Court under the terms of the lease agreement signed between the tenant and owner and in accordance with state and local law. Additionally, in accordance with a federal consent decree, landlords must follow additional procedures when they plan to commence eviction actions against Section 8 tenants: Required eviction forms must be submitted to NYCHA for approval (along with proof of mailing to the tenant) if the reasons for eviction are either:
Non-payment of tenant portion of rent, or Termination or suspension of subsidy resulting in a contemplated holdover action by the landlord Contact the NYCHA Eviction Review Unit at 212 306-8500 for the required forms.

If NYCHA objects to the proceeding, then the owner may continue in Housing Court but must also name NYCHA as co-defendant. If the owner receives no response to an eviction notification form within 30 days, then the owner may also continue the proceeding.

you don´t need an eviction lawyer – you need a good closing lawyer who does due diligence on the house and negotiates a good deal for you that includes the risks.
Remember “well priced” means the price is right for what it is.
As a first time buyer the chance of you overlooking something is much higher than the possibility of making the deal of the century.

don’t buy the house unless vacant, not worth time or your money to get rid of tenants.
