Neighbor Renting Property for Day Care Center

My neighbor is currently finishing a gut job on his duplex.  He intends on renting it to a family who will run a day care out center.  The people on the block told me they’re not happy with that for various reasons.  I truly dont know how I should feel.  What are some things I should consider/be prepared for if the in fact decide to run a day care center.

If he is running the program following all legal guidelines  then it shouldn’t be an issue otherwise the City will crack down on him. Some of your potential concerns could be noise but if its during the day and your at work it shouldnt be a problem. As long as the day care remains within its perimeter it shouldn’t affect your lives and shouldn’t be a problem. Just think of it as a separate additional to the commiunty. It will take sometime to get use too.

I am going to give you a wierd reason to want them there.  one of our neighbors used to run a day care and we live by a school.  While I can think of a few reason not to want either – the up side is they bring “responsible” traffic onto a street that may be otherwise somewhat empty during the day.  by responsible traffic, I mean the day care owners and employees and the parents.  When my son was home with a sitter for extended periods during the day, I was always happy to know that there were people around and passing through who could act as a deterent to undesirables who may case the neighborhood or were there in case something ever went wrong.  just a thought and that is how I flipped living by a daycare on its head.  Steve

I have a different opinion, My own garden/backyard butts against a woman who has numerous (and adorable) grandchildren in her home daily during the work week. The kids… being kids… run and play in the backyard.  I like children… was one once, myself. But my Lord… it gets so noisy with the excited screaming and crying… etc, echoing against the brick walls- that sometimes I want to pull out my hair. Everytime someone fall down or gets a ball taken from them… I hear screaming and whining. I can’t sit outside to relax or talk on the phone with the level of noise in the background.  This is fine once in a while… but every freeking day, all day long? My backyard is useless to me a good portion during the week. My only solice is that these kids will eventually grow up and stop being so noisy. If you live right next door and they have access to the outside, you will have a constand crop of young children who will likely being playing for hours during the day. That is something to consider putting a damper on. I don’t know your situation per se… but you might want to speak up now or forever grit your teeth after.

Slumlord issues aside, the daycare shouldn’t be an issue. Like curiosity, I live within a block of 3 of these. It was over a year before I’d even realized they were there.

There are a number of these home-bsed daycares in our neighborhood, and they don’t impact my life one bit.  One is around the corner, and another is a block away.  I suppose, if anything, it will be a asset–people like having a daycare close to home.  The only problem would be if it is poorly run, but the market tends to take care of that.

Thanks for the feedback.  We’re the new couple on the block (<2 years) and the old timers really like us.  And they've all had bad relationship w/ my neighbor for decades, and for good reasons.  The guy is a slumlord, he doesnt live next door but treats his 3rd floor tenant like shit.  Has been gutting the duplex since we've moved in and has not finished.  He's told me that the 6 contractors hes hired have all "walked on him".  So the reason I wanted others opinion is because I didnt want my opinion to be tainted by what the neighbors have been telling me.  I wanted to give him the benefit of the doubt.  Do ya'll think a day care center negatively impact surrounding properties?

There are many types of day care. Family style daycare could just mean that someone looks after 3 or 4 kids in their home and has a license to do so. This would be no different from having a family with 3 or 4 of their own children. A larger daycare needs all kinds of provisions – separate bathrooms, proper egress etc and it’s unlikely that this will be the case unless they are designing the apartment accordingly.  I can’t imagine what the neighbors are worrying about in either case though.

Generally speaking, any day care program planning to serve three or more children on a regular basis must obtain a NYS license or registration certificate. Google NYS Office of Children and Family Services.

FYI the house is a legal 2 family (B3-2 FAMILY DWELLING) in the R6B zoning area.  So can they legally run a day care out of that house?
