DIY noise from neighbor

Our immediate neighbor is DIY’ing his vacant rental apartment and taking his sweet arse time because he works all day like the rest of us stiffs. This means his DIY time is in the evenings during dinnertime and all weekend …the times when the rest of us are trying desperately to unwind from our hectic week. We are going MAD from the disruptive and erratic noise (heavy power tools, floor sanding, hammering etc at random for 2+ months now) but the most egregious offense is that he works all day and straight up to 9pm on SUNDAYS. We have spoken to our live in LL multiple times begging for help but he has been unwilling to intervene for fear of jeopardizing their longstanding amicable relationship. (Neighbor informs our LL in advance of making any noise so that they can vacate the premises during his DIY time. However we are not extended the same courteous notification from our LL) Twice in desperation, we attempted to speak directly with our neighbor and both times we were ignored. Our LL also became quite upset upon learning that we even tried that direct approach and asked us never to do it again. We are conflicted with what to do next: be “that guy” by retaliating with equally disruptive noise directed at the neighbor (ugh) or threaten to deduct rent from our landlord for every Sunday that he does not deliver our “right to quiet enjoyment” per the lease agreement. After ~17 years as NYC tenant, I find that “quiet enjoyment” is very subjective and therefore hard to defend with LLs. (FWIW we have documented every day and type of noise nuisance so far. We have not called 311 or the police. We are also over-market rate tenants which means we do expect some level of remediation from our LL). Thanks.

We attempted to speak to him twice. Once by ringing the doorbell (we saw him look through the window and then not answer the door) the other time while he was putting his garbage out. He didn’t even allow us to get through an introduction before going back inside! @ no-permits….Not worried whatsoever as we’ve already decided not to renew the lease regardless. Too many other headaches with this LL.

I totally sympathize with you, but in the scheme of things 2 months really isn’t that bad. I just lived through a gut renovation of the brownstone next door which took a year from start to finish – during which there was heavy construction EVERY DAY. I would suggest speaking directly to your neighbor – asking him to let you know when he thinks he might be using the heavy power tools – and otherwise take a deep breath & realize noise is part of living in close NYC quarters.

I say speak to the neighbor and try to work something out. At least find out how long you will have to live with the noise. Seems perfectly reasonable for you to know how long the disruption will be so you can make some plans. For all you know he could be finished soon.

Your landlord cannot control when the neighbor works. this is not my area but be careful of thinking this is about a right to “quiet enjoyment” — I do not believe the term has anything to do with sound levels but more with your legal right to be in the premises. As for warranty of habitability per the link above, the landlord is not doing anything to deprive you of your ability to live in the premises. 311 is your best route to complain about the neighbor — this is a DEP issue, not police, as DEP is in charge of the noise code. There may be applicable decibel limits at various hours. Go to NYC.gov and go to DEP page to see if there is any info on noise restrictions. Your remedy against a landlord who is not providing the courtesies you think you should get is to move. You are right that it would be nice if your landlord showed you more consideration and gave you a heads up about the sound, but there is no obligation to do so.

I lived through 12 years of daily construction noise, have called the police and 311 dozens of times even got the personal phone number of the Brooklyn DOB Commissioner and filled up their answering machine with recordings of late night construction. Nothing ever worked. Inspectors will show up a few days after the complaint is filed, cross off the complaint, then mark all future complaints as “see previous complaint”. I and 2 family houses have more relaxed rules for weekend work as mention. Floor sanding is considered cosmetic as is painting, cabinet installation, minor repairs… The only way I survived was by leaving town. No use getting in a pissing match with your neighbor unless you enjoy the feeling you get when you lose your shit and get all angry. Spring is on the way. Two months is really nothing. It will be over soon.

We live next door to a flip in progress. When the noise got extreme, I recorded it with my phone. Figured a record of it wouldn’t hurt. You can also download a free decibel reader for you phone and it might give you a way to quantify the noise. It may or may note be helpful, but in these situations it’s always good to have as much evidence as possible.

@ catboot – yes. We have asked our LL multiple times to pass on any info, however it does not happen. When the neighbor starts working, our LL just up and leaves (they have lots of family in the nabe so have alternate and immediate places to go) and do not answer their phone because they know why we are calling. Meanwhile we have lost our right to enjoy a meal, movie, or a nap in peace. @ bored – this is a very good idea thank you!

New York State housing law includes an implied Warranty of Habitability which includes an apartment that is free from unreasonable noise. So yes, the landlord is responsible. You cannot deduct rent, but need to contact him in writing, certified mail return receipt, with a listing that includes all of the times your right to quiet enjoyment of the apartment was violated. Then you can move on from there to housing court, etc. New York State Courts have a primer on the Warranty of Habitability: http://nycourts.gov/courts/nyc/housing/pdfs/warrantyofhabitability.pdf If both the LL and the neighbor are unreasonable, then there are really no easy answers here, and you may just have to stick it out or move.

Even the police won’t be able to do much, they’ll give him a warning first time around, maybe a 45 dollar to a few hundred the next few times around. But then he might just start making a lot more construction noise at the legal hours of the day. if it’s a 1-2 family house, he can work on Saturdays. Does he live in the building? My neighbor once told me of a story how her neighbors would always party into the late night. So, she went up to their doorbell at around 6am, kept ringing until they opened up and told them if she doesn’t get any sleep at night, they won’t get any in the morning.

The bottom line is that we are becoming very resentful of our LL (who remember, is being directly informed by our neighbor every time prior to his DIY work) for not then informing us of the impending situation. Therefore we are not able to make alternate arrangements whereas our LL is doing just that! It’s just a really dickish move.

We **_have_** been waiting and waiting. Patiently. That’s why this is becoming so stressful for us. What the guy is doing to his apartment does not require permits. It is strictly cosmetic so no DOB. Really do not want to engage the police, but sadly it sounds like it might need to come to this. Not sure why the LL wouldn’t use his good standing with our neighbor to politely inform them that his 3K rental income could potentially be lost over this issue? These are old-school Brooklynite homeonwers, not transplants.

Despite the relationship between your LL and the neighbor, you cannot hold him laible for the noise and you had better not deduct rent. In reality, it is not your LL’s job to remediate noise from neighbors. Nor is it his right to tell you that you cannot approach the neighbor. But, approaching him will likely do no good. You can call 311, the DOB and the police. Your best bet to have a real effect would be to get the DOB involved. It sounds like it’s being done without permits but the likelihood of getting them to respond on nights or weekends is quite low.
