So, does anyone have the definitive answer on whether PEX is legal for drinking water in New York City/Brooklyn? Even my inspector cannot determine for sure. I have poked around and found both answers floating around out there. This is on a two-family house. The PEX is new, put in by the flipper in both bathrooms and kitchen.

nay.     NYC has not adopted pex for drinking water. Other cities have, i think California is just getting there, but not here yet.

PEX is a safe and widely used tubing material (in europe at least), and there is nothing wrong with it.

I think I saw radiant heating supplies with it on the Build it Green website.  Where hot water heating is apart from potable water, also not code?
