Fine for Asbestos Removal by the DEP

Hello everyone. While undertaking our renovation, we had some asbestos that had to be abated. Our contractor hired a firm to do so, and everything (removal, paperwork) seems to have been done according to plan. However, months later, the DEP inondated us with letters saying that something had not been done correctly and that we were liable to a maxium fine of $15k. Our contractor reassured us that the removal firm would take care of it. Months have passed now since the first notice, and the court date has been repetedly postponed. Has this happened to anyone else? Should we be worried? It seems like we are on the line if this firm doesn’t pull through; thus we are hesitant to pay the final payment to our contractor until this situation is finally settled. Any suggestions about what else to do? Thanks very much in advnace for any advice!

Current regs require that an inspection and testing take place before construction is started.  If asbestos if found it must be removed before const is started.  Did that happen?  Did they give you an ACP-21?
