Who pays to repair lock?

When a tenant is locked out, and can not gain access other than using a locksmith, who covers the cost of the repair or replacement of the original lock? Landlord or tenant?

Tenants tend to treat having a LL like having a mommy. Mommy, I locked myself out — come fix it please! Mommy, I clogged the plumbing — come fix it please! Being a tenant does not absolve one of all responsibility for living. If tenant is assigned a key and loses it, he has to find a solution; if it can’t be replaced because tenant wasn’t smart enough to make a spare for emergencies, then tenant has to rekey the lock and provide LL with appropriate LL key. As a long time renter, I agree that the tenant pays unless the lock itself somehow broke (some old ones do break or things shift).  Even if copies exist, if the key was stolen along with ID’ing info (maybe a purse with wallet and keys) then they will want to replace the lock.  I’ve known friends whose LL’s wouldn’t give them more than one key to the place (so no key for a dog walker, friends, etc.) and have those hard to copy keys and in that case, I think the cost should be split.

Beyond security, In WWII copper was rationed.  Opulent designs for bronze locks, still around from the 1920’s, disappeared.  These and door knobs, peep holes and other hardware are valuable, nearly-irreplaceable antiques.  (They can be reproduced by a foundry, but still won’t be the same.)  It really looks great to see a building with all of the originals intact.  Many are lost because tenants or shareholders call locksmiths, who destroy them, and are surprised at the difficulty of “repairs.”  Others are stolen for scrap metal.  Managements should make known a fee of at least $1,000, but $2,500, would not be unreasonable in advance so residents would remember to store an extra key with a trusted friend, or with management.   While we are on the topic, many valuable perfectly preserved thresholds of terrazzo, or marble, matching all the others in the building, are destroyed by locksmiths who fail to adjust or secure entry door hinges.  These things too cost big bucks to custom fabricate, or may not be available at all.  Hey folks, if your lock is out of alignment, please check the hinges, don’t destroy the lock, and don’t let the door scrape and break the threshold, just because you have a loose screw!
