property owners can they get possession of rent control
We are looking for a rent control lawyer. that specializes in brooklyn townhouse tenancy. We have a house that was bought as a trust for my kids . The house is a 3 family house with 2 rent control tenants. We are now at the point of turning over that trust to our kids @ 21 &24 years of age. If the house is in their names can they get possession of the 2 apt upstairs that are rent control? Right now they are living with us and it is beyond tight. My oldest son is in a serious relationship and lives at home, my youngest son will be graduating in a year and will be working in NYC full time. Any recommendations would be appreciated.

Call the DHCR with your specific question. I don’t believe a trust can evict rent regulated tenants for owner occupancy, but the trust could possibly deed the house to the 2 kids as individuals, and then according to the fact sheet “only one of the individual owners of a building can take possession of one or more dwelling units for personal or immediate family use and occupancy”. I’d contact the attorney who did the trust for advice and/or a referal to a landlord/tenant attorney.
