Will the insurance company pay?
There are a couple of situations that I think may be happening in my Brooklyn condominium complex, and I’m wondering if an individual condominium owner’s insurance policy will pay a claim under the following circumstances. 1\. Owner sublets their apartment, and doesn’t notify their mortgage bank or insurance carrier. What if there is a trip and fall or other claim from the tenants? 2\. Owner installs a washer and dryer and doesn’t file a permit for the work. Will insurance pay for a large fire or flood? Thanks.

I put the same question as you note in 2 to my insurance carrier and they did not seem so concerned about whether or not the job was filed, but that it was done to code. My carrier told me that “it is their perogative to decline payment on damage caused by work not done to code.” that does not mean that yours or theirs or mine will not use not having filed as a way out. Since this is a condo, I am going to guess that a trip and fall inside their space would only impact the owner in that if such happen and the insurance company found a way out of paying, the lien would go against the condo unit itself which is deeded property as opposed to going against a coop which is really owned by the association (if a fall occured in common area, it would be the association’s insurance). Now, I know I just stuck my neck out real far on that one – I am not a lawyer and am only taking a guess at this based on the difference between condos and coops (I was a maintance manager at a condo association some years ago and the question about responsibility came up often in what-if situations; let’s see what some others have to say).
