XRF Testing Local Law 31

I’m confused! I assume that if the XRF test shows the presence of lead paint, but it’s covered by intact non-lead based paint, no remediation will be required. Does anyone know if this is correct? I have a friend who is also waiting for their report and is under the impression that any value over 1 on any surface requires remediation followed by another XRF test and is majorly stressed.

The other thing I’m questioning is the requirement that 3 family owners do testing in their own unit, even if there aren’t any children living there. Can the city force an owner to potentially remediate and re-test their own unit? Btw I don’t see this testing requirement for co-op and condo owners, even when children live in the unit.

Last question, does anyone know what we do with the report after we receive it? Upload it to the hpd website? Thanks in advance for any responses.

We used MKM Environmental Consulting. I just googled and called several places, getting prices that ranged from $450-$750. I wonder if prices go down if you don’t do it so close to the deadline. If there are no kids, you don’t have to do the testing now (I think it’s not for another 4 years).

I’m the crazy lady talking to myself here but maybe someone will find it helpful. We got our report and it lists areas where lead paint exists as positive with the condition as intact. The inspector says no action required.

I still don’t understand the requirement to get this testing in owner-occupied units though. Seems like 3 family owners are targeted there.

I’ve been reading more and understand I think. It looks more like it’s a record-keeping requirement and if the XRF testing finds a hazard, we need to show records of remediation by a certified professional (if hpd asks for it).
