Window guards

Yet another question – as Landlord to a family with a young child, do I have to install window guards, or can the tenant waive the right to have them? The tenant had asked me to install window guards selectively. Is there a specialized company that sells/installs them and are they all the same or is there a choice as well? Thanks so much for your help. As always.

I have a toddler. The window guards are in every window except the fire escape windows. So what do we do about air conditioning? This past summer, his room wasn’t air conditioned and luckily it wasn’t super hot. Since these window guards are not permanently in the window – does this mean his tiny room will just never have an AC?

I agree that the requirement is mandatory. But also, as a landlord you should want it to be mandatory (assuming you comply). That way there’s nothing to negotiate away from. I can’t imagine the horror — both in terms of emotional trauma and in terms of owner liablity — if a tenant wasn’t paying attention and their five year old decides it’s time to play Spiderman outside by climbing through the window.

Your tenant should also be aware that if ACS were ever to become involved in their family, the existence of window guards is one of many factors in evaluting fitness for continued custody.

My company “Brooklyn Security Window Gates” 718-755-3034 has installed thousands of these “childguards”….Tenants remove child guards all the time (usually for air conditioners) with impunity because no one checks….If you have no children most property managers have a form you sign stating you have no young children, absolving the landlord from having to install them…Child guards could also be a low level burglary deterrent as well in some cases….because intruders can’t push the top down (obstructed by CG) and climb in….

In follow up, I’ve called 311 who were unable to provide information (they can file complaints against landlords who refuse to install window guards). They referred me to the Fire Department at the Health Department. Health department was impossible to reach by phone, while the Fire Department was surprisingly easy. They advised that all windows, regardless of height off the floor, required window bars. However, if you only have one entrance door, you need to have 2 additional exit points, so leave 2 windows without guards. Both Home Depot and Lowes near me have NYC approved brands of bars. They seem to come in black or white and are cheap (around $20-30 per window). They come with special one-way screws that take a flat-heat bit to install, but will require a special tool to remove. Also on the city website there is a list of city approved brands and models.

Crest hardware in Williamsburg, Home Depot, and the bigger hardware stores in the neighborhoods all have them. They’re supposed to be installed on the outside. It was beyond me. We got an experienced handyman to install them. The cost of the guards plus the installation is more expensive than you would probably imagine.

If a child 10 years of age or less lives in the apartment. you as the landlord must be sure that window guards are in every window except where there is a fire escape. You the landlord will be held liable if a child falls even if a tenant has signed something to say that they did not want them.
You as the landlord can charge the cost of installation to the tenant; this provision was added so that landlords could not use this as an excuse not to rent to people with children.
Most local hardware stores as well as Home Depot, Lowes etc sell them. Any competent hand person can install them. It does mean screwing them into the wood moldings, there is no “Landmark” historic ones, just the black ugly NYC approved generic ones.
When this law first came out I had some wrought iron “Juliet balcony” type iron guards installed on both Parlor floor front windows above the outside window sills and installed window boxes in them; the tenant filed a complaint about something else and the inspector gave a violation for not having the approved window guards. So just go with the boring ones available.

I’d like to know this, too. I am also wondering, if, on double-hung windows, can one install restrictors to prevent the bottom sash to opening to, say ,only 4″ (but allow the top one to open as it seems there’s no danger to kids there?)
