Water from neighbor´s roof comes down onto our backyard.
Our neighbor´s downspout goes directly into our back yard. When it rains, the water from his roof comes in hard and heavy. We have only one floor drain in the yard, and it usually doesn´t take long and the drain is blocked with leafs and other debris and the water level begins climbing. This is not much of a problem when someone is home and can clear the leafs and debris. But this is not a sustainable situation. Does anyone know what the legal situation is? In order to solve the problem entirely, the neighbor would have to repipe his storm water system, which is costly, I am sure. Thankful for suggestions, insights, experiences.

In the historic districts of Brooklyn, In an attached brownstone, on a 100 ft lot, disconnection of a downspout is illegal (to avoid flooding your neighbor). Last year, the law was revised to allow for collection of rainwater via a rain barrel or underground tank system or installation of a green roof. If using a rain barrel, they must have diverters that re-direct the overflow back into the outgoing sewer line. If you have a free standing house, or one on a much larger lot, code may be different. We’ve re-visited this many times over the years. Owner is liable for any damage done to neighbors property if flooding or water damage occurs due to disconnection of downspout. If I were a new buyer, I’d sink a tank in the back yard for water collection 😉

DO NOT do anything that could result in damaging his property—diverting the water, or plugging the water source sounds fun but almost certainly will make you liable for the inevitable damage to his property, as ridiculous as that sounds. And the stakes could be big time for something like this, where your action could be the source of basement floodind and destroying property, or worse the wall deteriorating and collapsing, and so on. You really don’t want that.
It’s bad juju to threaten your neighbor so try to make it seem like a problem the two of you are working on together rather than a demand. I’d hate to get the city involved as well so perhaps say this is time sensitive as it is damaging your property. Say you want to keep it between the two of you but this is a priority, so let’s call in some guys and get estimates. But set a firm schedule of a couple weeks for contract and another couple for work and say you spoke with your insurance broker (do so!) and that issues arise if you don’t care for a known condition ina reasonable time and so this has to be resolved ASAP.

Not sure where you live, but in brownstone Park Slope all downspout water must be attached to outgoing sewer line (down the back of the house, into the cellar, out through the sewer line). If someone has disconnected and is letting roof water run into the open, either in the front or the back of the house, it’s a violation.

We have a similar situation. We had no success talking with our neighbor and decided to bite the bullet by attaching a barrier on our side of the fence to redirect the spillover back into his yard and moved our drain to better accommodate the water in our yard. I can’t tell from your photo if you have any similar options. We didn’t want to escalate with getting the city involved for now.

i’m not sure if hydraulic cement would adhere to the pvc. Personally, i’d either glue in a pvc plug or use one of those rubber plugs that expand by turning a screw. After which, do not allow them onto your property. Those pipes should be extended within his building, down into his cellar and connected to his sewer system.
Calling 311 and getting a complaint in with the department of buildings will just be frustrating for you. It’ll take 3 months for someone to get out there to look at it. You’ll let them into your home to inspect the issue. They might take notice of any work you’ve done, and the fact that those A/C units aren’t 3 feet away from your neighbors property line. The neighbor will get a violation, but theres no time frame for when he has to fix it. So you might still be stuck with pouring water for years.

Thank you. I have photos and videos. I spoke to the neighbor on June 20th. I invited him over and showed him the damage, and also showed him a video with huge amounts of water shooting out of his pipe onto the property and the difficulty the drain has handling it. He answered he had been made aware of it by previous owners, but had bought the house with this condition. He said he would take care of it, but asked for some unspecified time. I will keep pushing in a friendly way for another two weeks before I take additional measures.

There’s lots of good solutions here. Whatever you do – document it. Make a call to 311 – keep the record. Discuss it with your neighbor – write a summary of what was said with the date etc. Email a follow up so you have another record.. If you ever need to go to court, small claims or proper court, you’ll need all your documentation.

Take pictures and video when it is really pouring out, speak to the neighbor about putting in a (replacement) downspout. Also point out that the water is damaging his building — see the staining?
Meanwhile, you might want to discuss with your attorney a lawsuit for ongoing nuisance and trespass. If you have to sue, ask for lots of damages caused by the water and get the DOB involved because your neighbor’s wall will eventually become a hazard.
That will get a response and I hope, a solution. I know several folks who have tried the friendly approached and have been rebuffed. So if your neighbor does not want to be cooperative, what’s to lose by bringing them to court.

This is clearly against code but the Dept of Buildings and 311 in this city are a complete joke. Talk to your neighbor. If they won’t fix it suggest you could split the cost. If still no joy then try blocking it up with something. Make sure it is attached to the surface – thus only on your side of the property. They’ll reroute it after the first heavy rain.

@Arkady It against current code to connect a down spout to a waste line. But I have one and it was legal back in the day.
Your neighbor cannot drain on to your property. You should talk to him/her about the problem and ask that they fix. If they wont, you may have to go the route of making a 311 call. Or, if that doesnt work, sue.

Most houses have a down spout that goes directly into a waste line. I’d find out if that’s a law by phoning 311 & being put onto EPA.

Wow, I thought it couldn’t look that obviously bad, but surely there is something they must do about this. How to make that happen, I’m not sure, but it does seem like they should be responsible for fixing this–it was obviously done on purpose, not some work that ended up rerouting water to your property.
