VERY IMPORTANT NYC TAX COMMISSION HEARING COMING UP!

Do you remember being gobsmacked with NYC Local Law 152 for gas line inspections? Remember the confusion and frustration about that potential $10,000 fine? Remember how many of your friends and neighbors scrambled to comply?

Do you remember how this scrambling led to a knowledge of ANOTHER LAW the city attempted to implement about potentially requiring kitchens in our homes to be outfitted with sprinkler systems? THANK GOODNESS everyone coalesced to attend the virtual hearings to testify against that, and whew! WE (hopefully) DODGED A BULLET on that law (at least for now)!

Well neighbors, it looks like we’re going to get GOBSMACKED AGAIN, if we don’t coalesce around the UPCOMING NYC TAX COMMISSION HEARINGS!

If you don’t yet know, the NYC Council created a Commission to review and suggest changes to how our brownstone homes will be taxed. Even more important, the suggestions have been published, and the hearings on those suggestions are getting ready to be discussed.

In 2018, Mayor Bill de Blasio and City Council Speaker Corey Johnson established an advisory commiss ion to develop recommendations to make the City’s property tax system simpler, clearer, and fairer, while ensuring there is no reduction in revenue used to fund essential City services. In early 2020, the Commission released a Preliminary Report, which included 10 initial recommendations for reform. The Preliminary Report also included a brief history of New York City’s property tax system, the current methods that the Department of Finance uses to calculate property tax bills, and challenges with the existing tax system. The Commission initially planned in-person hearings on this report for March 2020 in Staten Island, but these were postponed due to COVID-19.

The commission is now seeking input from the public on the initial 10 recommendations at two borough-based Zoom hearings for Staten Island (May 11) and Brooklyn (May 27) beginning at 6:00pm.

We urge all New Yorkers to read the report, attend a public hearing and make your voice heard. Your feedback will be critical to the Commission as it develops its final recommendations.

To testify, you must sign up on the Commission’s website no later than 24-hours in advance. All hearings will be broadcast to the NYC Council’s virtual hearing rooms, with a link on the Commission’s website: https://www1.nyc.gov/site/propertytaxreform/index.page. The Preliminary Report can also be viewed on this website.

To ensure the Commission hears from all those interested, speakers should plan to speak for no more than two minutes. Commission members may use additional time to ask the speaker questions. Elected officials will be given the opportunity to speak first; all other participants will be heard in the order in which they sign up.

I did. It was very interesting to hear stories from people and what they are going through. Several people talked about NYU and Columbia amassing a huge real estate portfolio but not being taxed enough. There were people born and brought up in Brooklyn and could never afford their houses now but don’t have the income needed to pay the taxes. Nor do they get rent as the whole family lives there. Similar story with many middle class folks who bought houses in the 80s and are now in neighborhoods where taxes are up but obviously they don’t make as much as people who moved in. Also people who scraped together money to repair their homes then got taxed heavily as a result. People in old condos getting taxed the same as the luxury building across the street.

One of the commissioners said that if the new Mayor doesn’t back this commission then it’s dead. They urged everyone to reach out to their council person to make sure that it continues.

After listening, I would urge people to submit written testimony.

The Commission is sham and deBlasio is out in 7 months. The courts will decide this issue, not some useless commission.

Yes that’s correct which makes no sense. As a hypothetical example, one could structurally stabilize a building that was on verge of collapse and DOF would tax your repair as a capital improvement.

Doesn’t the assessed value increase for permitted work even if the property is alread assessed at market value? I suppose it would be less penalizing if the overall tax rate were lower. But it does seem like it would promote flipping since the prices of unrenovated units would go down due to the higher taxes, and the price of the renovated units would go up due to the relatively lower tax on fully assessed units.

– Doing work legally penalizes the tax payer
– Many properties are not in the right tax class and some owners may not even be aware they aren’t
– Lack of transparency regarding how they *actually* calculate increases or your tax

Old clowns get replaced with new clowns. No repercussions for their proposals so it will continue. A class action lawsuit would change things faster but that’s probably hard to do.
