Tenants ending a month-to-month lease

Can anyone clarify the terms of ending a month-to-month lease? As a landlord for almost 20 years, I thought that either party could terminate the lease before the 1st of a month and it would be effectively terminated after the next full month…i.e. Notice provided on, say July 30th would mean the lease ended on August 31st, but notice given on August 10th would push the end date to September 30th.

In trying to research this, I think I’m seeing that those are the terms for the landlord, but the tenant is only subject to 30 day notice, so the above scenario would mean that notice given on August 10th would mean an effective lease-end on September 10th?

Any official word on this? Everything I read is confusing!

The new rent laws should not affect when to give notice and mostly apply to rent stabilized apartments.

NYS rent laws have drastically changed as of June 2019. Find a real estate attny who understands the new laws – if you don’t, you risk litigation. The new laws are very complicated and there has been no grace time. Understand them if you are a landlord because your hands are tied in many instances.

Legally it is the same notice requirement. Thirty days notice needs to be served before the 1st of the month that the lease will end at the end of the month of.
But all landlords know that some tenants will often do what is convenient for them, and there is no point in trying to hold a tenant to the law. The costs of doing so, cost more than the amount in dispute.
