Tenant mattress ruined. Roof leaked
We have been tenants in a loft apt for 6 months. A month ago the roof, without warning, leaked and ruined our mattress. We immediately contacted the landlord and he immediately fixed the cause of the leak which was a rusted seal around the drain pipe. Our renters insurance denied coverage of our personal property stating that the leak was caused by maintenance negligence. Our landlords are also refusing to cover it. Any thoughts?

i just got a new king size mattress from one of those direct to consumer companies and it was around $1200. it is by far the nicest mattress I have owned.

More importantly, how old is the mattress? Figure you replace a mattress every 10-15 years, you should only expect an amount proportional to the remaining life expectancy of the mattress. To get full replacement cost for a 10 year old mattress would be a windfall.

It was a. Wet expensive mattress but has some wear and tear. To replace ithe same quality would be 2500-3000$. Maybe ask for one months rent? The duvet was also ruined. The other things were washable. But we are still not back in the bedroom bc I won’t sleep on the mattress. It is full of rust and tar. It has been a month.

LL should pay for the value of mattress. This is LL’s responsibility but you are not entitled to a windfall. If it was an old mattress, don’t demand or expect full replacement value. Allow for some amortization (you were going to buy a new one at some point) and suggest meeting the LL part way.

Call the landlord (or the building management) back and tell them what happened with the insurance and ask if they would cover even part of the cost. Maybe throw out a number — $500? — and reiterate that the mattress would not have been ruined were it not for the leak. Keep it cordial. No threats of a lawsuit or small claims court.

It is the landlords responsibility as your tenants insurance states because of the landlords negligence of maintenance. Your landlord obviously does not care if you want to renew your lease……… That said do not submit a bill for a $2,500 mattress if it was from IKEA!!
