Small Claims court against con edison?

Anyone know if there is something stopping me taking Con Edison to small claims court? On the 8th of February a Con Edison road crew operating a water powered diamond saw were working on a neighbors building flooded our basement causing damage to the boiler (electrical shorts/destroying the sump pump with mud etc etc). Anyway after being shuffled around from one person to the next our claim has been “DENIED” with the Pro Forma letter that says “Con Edison” is not responsible for high service reliability”……uhm yeh ok, i’m not suing you for service/heck our power was on the entire time-I’m suing you for flooding our basement. Anyway long story short as the entire damages are only $2037.05 anyone know if there is anything preventing me from taking them to small claims court? Lol how about winning a little extra for stupidity….? Cheers, Dean

Public Service Commission works for Con Ed. We are having an issue that in our building, whoever build it made lots of mistakes with the electrical connections, apartment meters are confused. We try to reach out to Public S. C. and they took the side of Con Ed. Technically they work for the State but they had many complaints against them because they refused to be impartial.

Basically the bill is $2037 + court costs + statutory interest and I don’t see how we can lose so drinks are on me when we win.

I had a flood due to water flowing thru Co Ed conduits for the main electrical. After may go rounds with the usual gang of idiots, I got hold of their legal department and made some noise. I was advised not to put a claim in with my insurer. They wrote me a check. they WILL settle. Just get an inspector to come. Get a higher estimate. Keep hounding them. Small claims is a pain in the ass.

I am not sure I would ever submit anything to my insurance company – but I may be wrong. It is a shame that you have to considering suing a public utility who was negligent in the course of their work. Have you tried other options? I had a problem with a car dealer years ago and I went to the state atty generals office and they were able to remedy the situation in my favor (though there might have been fraud which is why it worked). what about your council person’s office? might they be able to make a call. also, when calling big companies, sometimes they want us to go through the “call center” which has only the resources and brain power to handle everyday issues – the “power is out” or a branch is pulling on a utility line; hence your standard form letter reply. I have had some issues with big companies who only give out call center numbers and i have found that getting the phone number to the corporate headquarters and calling the offices of executive VP’s gets results – those folks don’t like to be harrassed. Maybe even reach their legal dept that way. I have not checked to see if Con Ed lists their headquarters number, but I can tell you how to get it if they do not make it available: look up their security and exchange commission filings – they are all on line now – and they will have a number for a senior level officer on there and you can start by calling his office; he and his assistant won’t like that at all and you will get results.
