Sidewalk Violation on Landmark Block
I received a sidewalk violation, along with everyone on my street. I signed up for the DOT to replace the 2 concrete squares and heard back that the property was not eligible since “construction of your sidewalk will require a ‘distinctive sidewalk treatment'”. These are run of the mill concrete sidewalk squares – not bluestone or anything like that. When ConEd had to replace a square earlier this year, it was no problem. Has anyone had this issue before and how did you address it? I really prefer the City to talk care of it since they can’t complain it wasn’t done right and the expense of getting Landmarks and DOB approvals.

I recieved a violation on a historic district block for minor repairs that said if I didn’t repair it, they would (at a cost far less than any private contractor) Still waiting for them to repair it. It’s been about two years-haven’t heard from them again.

OP here. I have learned more than I ever wanted to know about sidewalks. Landmarks told me that LPC no longer has jurisdiction over sidewalks in certain Landmark Districts. Mine, the Upper West Side/Central Park West Historic District, is one that is exempt from needing LPC approval for work on the sidewalk. Of course, exterior and interior changes still require LPC approval. Furthermore, DOT told me a new law makes sidewalks damaged by tree roots the City’s problem and I don’t have to pay to fix it. The exception to this is when you use the City’s expedited sidewalk repair service. When they come to fix the sidewalk, you have to pay for everything, including the tree root damaged squares. Originally, the DOT told me that I was not eligible for the expedited service. Once I showed them the LPC law, they corrected that but want to charge me $1,400 for the expedited repair. My alternatives (other than the expedited service) are: get a DOT permit, repair the single cracked square OR get on the list for the City to repair both squares (although I only pay for one). The latt er could take 5 years, and in the meantime, I am liable for trips & falls on the cracked square (but not the one next to the tree). Off to the DOT to get a permit….

You could hire a DOT registered contractor to do it. I got a quote once for about 750 for one flag, but they know how to do the paperwork.

When everyone on my landmarked block got violations the City did the new sidewalks (for considerably less than a contractor would have charged). However that was >20 years ago.

Ask for a second evaluation & talk to the inspector who comes.
