Seeking Successful Property Tax Challenge

I challenge my property tax every year and lose, so this year I plan to take it to the courts. Anyone have experience with this. Can you recommend a company that’s had luck in getting the tax reduced?

One can have a lower mkt value than someone else and still have a higher assessed value so it make it seem like the market value is not a determining factor. According to DOF it’s the starting point for calculating the assessed value. However, that’s where it starts to get murky… They make it sound like a simple formula (assessed value = mkt value x .06 for tax class 1). In reality, it’s not so simple. I have pored over all the information from DOF and the Tax Commission and they don’t reveal the additional factors and variables that determine the assessed value. As others have mentioned, CO, permits etc. are factors but am yet to figure out how they apply those numbers. If anyone has figured this out, please enlighten us.

I didn’t win, hence me saying the tax won.
It was a several years ago and every step they yes’ed us to death, said we had a case, jumped thru the hoops then got the decision letter saying everything they did was correct, proper and all their numbers were correct.

@bkallday wow that sounds horrible. i always feel like any dealings with the city are painful and you risk opening a can of worms, between the DOB, DOF, etc i dread the day when i have to do any work that actually requires a permit or any filings!

@Oliver_nyc our house was a rooming house when we purchased it. We did the reno, complied with all the CoNE and Building Department rules and for YEARS they would not change the designation. What I never paid attention to was the taxes. I just assumed they were normal increases. I was focused on getting it designated as a two family. In attending a community meeting years ago the subject came up for a family that was changing a commercial and 3 family to a 2 family and they had the same problem. When I spoke with the wife she told me about the “tax” issue.

I battled with DoF and finally they changed the designation to the legal 2 family and my second battle front was to get reimbursed for the 12 years they had it improperly listed. They told me I could only appeal for the last 3 years and they appeal had to be submitted within 30 days of the receipt of the new tax bill for the year. They wiggled their way out of it and to be fair I dropped the ball. But I took over a dozen visits to that horrible office and it was always and excuse. They always needed an o riginal paper or some oddity. Suffice to say nothing works in our favor. It sure as hell works in their favor when it comes to them owing money to a homeowner.

@mdr thanks. that’s basically what i just did. let’s see how the respond. my market value has gone up over 600% in five years. i didn’t really pay attention in the past since i know only the effective market value (whose increases are capped) matters. but now they’ve got my house market value way above where almost anything in brooklyn has sold! i’m beginning to think it must be some kind of clerical error… fingers crossed they correct this.

@oliver_nyc Yes, I filled out the form “Request for Review of Property Value” and sent it in. I gave them information on four comps that had sold in the previous year. I challenged the market value because it went from $1.81M to $2.86M in one year and that didn’t make sense to me. Nothing in the neighborhood had sold for that much. The city did adjust it down a bit to $2.64M. A year later they dropped it down to $1.97M. But as I learned, it didn’t matter one way or another, the property tax goes up a small amount each year based on Assessed Value. And I learned that my taxes are actually pretty reasonable compared to others. It seems to me that since there is a cap on the year-to-year increase the homes that were in struggling neighborhoods 20 years ago have retained a legacy of lower taxes.

bkallday are you talking about challenging the “effective” market value (which drives the taxes paid) or the “market” value listed on the form? the latter doesn’t actually impact your taxes but i’m challenging it just to correct the record. i understand the effective market value is almost impossible to challenge since for most people it’s still below the value at which the house would sell. not a single comparable house in my neighborhood has sold at where the DOF has my market value. they’ve upped the value of my house 600% over the last six years!

I have tried and failed multiple times and it’s always over some arcane rule they whip out. They won’t be beat. It would set a precedent and that would invite litigation. If you win, I will pass a hat to rent you a billboard that links to a site on how you did it. The situation is getting out of hand.

MDR – how did you challenge the market value? just via the online system? did they come and look at the property? how much did they ultimately reduce it by?

i understand the market value doesn’t matter in the current system of caps but given it’s about 2x what i think our house is worth, it probably worth correcting if this new proposed change goes anywhere.

No-bo-dy can challenge market value in BK because they jacked it up so high.
I am also paying 3 times as much as my neighbors because of a C of O change. After you ask 2 or 3 pointed questions no one can explain the real reason. It’s all made up.

I challenged their market value once and got it reduced but it doesn’t really matter because the tax is based on the assessed value. The assessed value increase is capped at 6% per year. You can look at any property’s taxes online. From what I’ve seen everyone’s taxes have been going up 5-6% a year. Still, our taxes are much lower than in the suburbs.
