S9 class building question LNO question

HI, I have a bad paid tenant and he’s threaten to call 311 on the illegal office on my second floor.
I don’t want to get a violation on it. so i want to cover my butt and get this resolve before he start making calls.

*The building is in Jamaica queens.
*The building was build in 1929.
*There is no CofO.
*district code: C2-3/R7A/DJ (special Jamaica district)

My question is can i use all the available space as
office commercial space or i have to balance it out?
like 50apt/50com right now is all office and commercial.

Should i get a letter of no objection and go from there?
