Removing Old Oil Tank - permit needed??

We have an old oil tank in the cellar and would like to get rid of it. Does one need a permit for this job? Or can it be done done so quickly that hopefully no one will notice?

One quote I got the guy didn’t mention anything about a permit, but another guy said you do. Who is right?

Also what is a good price for this job? The two estimates I got were $800 and $1200. Thanks!

no permitz: you still read it. i cut it with a hole saw and opened it with a sawzall to vent it and then used the grinder. it would not have exploded once it was vented with a large hole but i was and still am surprised it did not catch fire.

after posting about something i should have done, i had to check the codes and come back on here. i could not leave this alone.

OP: no permit is needed to remove. i read the dob codes on this and section 34 of the fire code and it does not even specify that the FDNY must be notified that one has been removed yet someplace else i read they are to be notified.

res2: as it turns out, there is one sentence buried in the fire code that states that a plumber (and they mean licensed plumber) must remove these. so you are right, i should not be doing this. when i removed my tank 10 years ago now, i read a lot and looked through the codes trying to find out if it required a licensed trade. i found no such statement and after cutting the tank up i left the pieces in full view for two or three days as i waited for the scrap man to remove them.

to all others, since tank removal should be done by licensed plumbers only, i am sorry i came on here and told people how to remove one.

residence2: Point taken and i just checked, i could have disposed of it at a free DSNY drop off.

I admire your conviction and we need more of it. but i am not sure there are laws preventing a homeowner from removing a tank so long as it is done safely. even though my business insurance would not allow me to remove a tank for hire, it will also not allow me to do electrical work or relocate plumbing, but their are codes in place specifying that. my insurance also does not allow me to do roofing but there is nothing to stop me from working on my own roof (and i am not a roofer) or even someone else’s aside from the insurance restriction. i did read a lot about this before proceeding at the time. the waste disposal seems to be the only real issue and i did burn the remaining oil in the furnace.

the insurance co would probably not want to be involved with a spill which did not happen here. as for the neighbors, when they need scraps of wood and have to borrow tools, they seem to forgive me for the other things or watch with a distant curiosity. they watched me swap engines on my wife’s car a year back and yes, i spilled some transmission fluid on the ground – but when all was said and done they praised me on my accomplishment considering my age.

you are right to say something though as one of my big complaints is unqualified contractors working around the city. i would never offer to do this for someone else.

i generally do not speak about things electric or plumbing on this site (and i took a wiring class years back and have installed plenty of circuits in commercial buildings working for others) as i do not want to encourage people to do things we are not licensed to do. if i find out a licensed person is required to do this kind of work, i will come back on here and advise. maybe master plumber will pipe in here.

since this guy up above called me out for using an angle grinder to cut a tank up – and i did use one – i thought about the safety of anyone considering doing this and thought about how i went about my project: before i began in earnest, i used a hole saw to cut vent holes in the tank in case the heat and sparks ignited the oil. that oil does not ignite easily and when it does it burns kind of weak, with a lame, smokey flame. i can drop some diesel (no. 2 home heating oil) on the ground and put a match to it and it will not light (gasoline will). so i vented the tank and my intention was to cut it up with a sawzall but even with the correct steel cutting blade, it was very slow. so i cut a larger vent hole with the sawzall – a hole the size of a sheet of paper – that way if the oil ignited, it would simply burn as opposed to build pressure. i think that is what the guy above was thinking about – a pressure vessel filled with heat. once i had that hole in the side of the tank, i went at it with a grinder and even with the sparks, the oil never ignited. as i said in my earlier reply, i had a litany of fire extinguishers on hand including a massive co2 one which would put the oil fire out in seconds.

i think a lot of people get in trouble with vessels like these tanks when they do not vent them.

the only reason the oil burns in the furnace is because the oil burner atomizes it.

the guy above was right, it is probably risky. but i did it and managed it safely so i either have more than a clue or a lot good luck.

resident2: i like that you discuss disposal and the price differential in the same post; take it from a contractor: that $400 dollar difference = the difference between waste dumped on the side of the road someplace and waste taken to a proper facility.

a scrap metal guy was glad to take the metal from my tank and i was able to run about 20 gallons of fuel oil through cheesecloth and reuse it and the sludge was absorbed with sawdust and absorbent and put in trash bags. the sludge probably equaled three 5 gallon pails.

had 20 gallons of oil spilled here, i would have had a night mare with my neighbors and they would have had the EPA here.

also, to add to this and i know because i am a contractor: the insurance policy for this kind of work would have to be a bit specific. i do not think a generalist’s insurance policy would allow for this kind of work (mine wouldn’t); insurance is something to check when hiring people to weed out the legitimate operators from the shoddy ones; if you go with that 1200, ask to see his insurance cert.

It does need to be filed with the Fire Dept & I believe the EPA is involved these days a swell. It is a filthy, stinky job and you cannot just put all that filth & iron out in your recycling! Disposing of it is not easy. Check how they are disposing of it.
Go with a company that spends all day removing Oil Tanks.
Also if you have not used the Oil Tank in many years; it may well be full of sand or water. It may be decommissioned with the Fire Dept already. But still use a professional Oil Tank remover… makes your life so much easier to get it done, paperwork done etc. $1,200 sounds about right. $800 something is missing!

advanced build co: then please explain how i managed to do this with my house still standing? no “big boom” as you mention. perhaps the “‘a’ idiot” is thinking of fumes from gasoline and not diesel (no. 2 oil)?

was i concerned about fire? yes. i had 6 dry chemical and co2 fire extinguishers placed around my work area. still, no issues.

i have been working with welding and grinding equipment since before you were born (i can tell that by the way you write and use language) and i am still alive and have never had a “big boom”.

i cut mine up one saturday morning. there was a lot of sludge in the bottom of the tank and it made a mess; prior to starting i had a couple bags of speedy dry/absorbant on hand. by the time i was done it was a full day. also, my basement opens in the back yard so the pieces were easy to remove; yours will probably have to be cut down more/lifted out= more time.

i did not notify anyone.

800 two guys is fair i would say. 1200 is probably also ok if that company is playing with full insurance and operating above board and taking decent care of their employees.

if there is any oil left in that tank you want someone with more skin in the game; ie, insurance and willing to take responsibility. you do not need 25 gallons of oil spilling in your basement as it will leave an odor (i dropped a lot here on my concrete floor and really had to clean it up; a dirt floor would be worse; it is realistic that there will be oil in an “empty” tank). i could not drain my tank prior to cutting as the lowest drain plug was clogged by sludge and any holes i drilled became clogged.

as a contractor, this kind of thing is not really my thing. the only reason i did it myself was i had the tools to do so. what i am saying by telling you that is this kind of job is not really beyond the reach of a homeowner who has an angle grinder. just messy.

If just removing the company removing it needs to submit an affidavit to the Fire Department, I don’t believe DOB are involved.
