Reform 311 Anonymous Complaint system

Have experienced harassment with fake 311 complaints and inspectors coming to your property all the time for no reason. If yes, please let us know. We are a group of landlords and owners in NYC trying to push for a new law to prevent this form of anonymous harassment which stays on your property record for in aeternum. Right now there is no law and owners victims of such institutionalized (enabled by 311 and all the city agencies) bullying cannot even file a report with the NYPD to stop it.

We are trying to build some momentum to change the law which is unfair and unconstitutional. 311 yes but to help tenants and citizens with real problems but not to allow harassment at will with false complains because of ulterior motives.

If you called the DOB (3 in Brooklyn) commissioner and NYPD they would have come long ago. Going down to talk to a lower middle rank employee will not get you anywhere. They can’t even set their voicemail properly. Mention fire hazard and they come within 5 minutes. Try and let me know.

Landlord if you don’t believe me or the other person who had a similar experience with someone building a unpermitted structure and dealing with a very poor response from 311 and the dob that’s your problem. Developers build without permits everyday in Brooklyn. I finally went down to the building department to speak with someone and was told that a complaint of this sort has a 50 day response time. A building official told me that unless certain key words were used a next day response would not happen. Your concern is that a tenant is going to harass you. I am talking about someone working illegally, a wall falling from the second floor into my backyard, building a wooden four story fire hazard in a week, coming onto my property without my consent and now leaving the structure have built and putting the property up for sale. Don’t tell me I don’t know what I’m talking about I’ve had to deal with this for months. I’m trying to help people out. This is totally different then being bothered by a tenant.

myuncle in Midwood has received more than 300 robocalls from HPD because some ass decided to make fake complains to 311 about him. he made one complain about a dangerous dog on his street and thinks that guy is making all these calls now. He can’t block the HPD numbers used to make the robocalls. and he can’t change his phone he’s had for 15 years now. the police won’t let him file a complain. should not be allowed but HPD and thinks it’s okay and so does 311.

not intentionnally designed but became a major tool and it’s fixable but they have made a decision not to fix it. why? because it serves the interest of a few it seems. a law proposed by three coucil members was intended to fix it in 2013 and it still not in the agenda. why unless 311/dob/hpd see an interest to keep this very broken.

the system has its faults but the ability to anonymously report problems, while it allows the type of harassment, also prevents revenge by building owners or other responsible parties against tenants/workers/clients/public who report dangerous or unhealthy conditions. nobody will deny that NYC laws are tenant-protective rather than landlord-protective, but there’s a very extensive history attached to why that’s the case. the system might very well be broken and i certainly don’t know how to fix it, but i don’t agree that it was intentionally designed to harass. it can be used that way, which is unfortunate, and if there are steps that can be taken to fix that, great, but the system has merit. don’t throw the baby out with the bathwater.

2345bode bullcrap ! you work for 311? the whole system is designed to harass at will with no accountability ! I could file a complain online about you to 311 for the rest of your life anonymously and it will be on you record for ever. good luck finding tenants if people see you have bed bugs or do not provide hot water etc.!

even if 70% are justified the rest is completely redundant and a waste of resources and a tool to harass with zero accountability for people harassing others at will. Bad and completely system ! Some inspectors come 5 times for the same false
complaint.

I want to sympathize with your situation but right now I am in the polar opposite situation. I I have called a ton on someone who is doubling the size of the house with no permit at all. Who cares what anyone says or calls into 311. It does not matter one lick. Keep working. 311 is the joke of your town…

I know that some city council members are trying to reform this East Germany inspired system but that agencies are lobbying against it as this would end the thousands of useless taxpayer-funded inspections done after every false complaint is registered through 311.
