Recourse on LPC violations received PRIOR to closing?

We purchased our renovated home in a landmarked area and were told by the developer that all facade renovations up to LPC code. (We are now learning what REAL Landmark renovations entail.) Before we closed, our attorneys did a violations search and found nothing. However, a month later, we found out that the property was issued 7 LPC violations two weeks before we closed on the home. To cure the violations, we need a new door, new windows and host of other things that amount to at least $80,000 of work.

Are there any attorneys that specialize in pursuing developers for negligent work? Anyone else have any experience or success with something like this? Thanks.

How long does it take for an LPC violation to be recorded and available on public records? Is it possible that no one could have known about the violation because it wasn’t posted before you closed? I hope this is not the case, but the City can be really slow sometimes.

From experience: threatening an attorney with a claim of malpractice often gets results. Insurance companies base their premiums on risk, and claims, even if not upheld, cause a rise in premiums for the attorney. I agree that officially sanctioning an attorney through the NY Bar Association takes time and effort and is probably not worth it.

From the facts you described it seems like the attorney was negligent and may have committed malpractice. As others have noted, a good attorney will check for violations on the morning or night before closing. Yours didnt and you should not have to pay for his clear error.

Waiting for the seller to make good on this seems to me to be another waste of time.

Agreed. Not to be done lightly. the “time and effort” will be mostly on the lawyer you hire to do this; but you might spend quite a bit on legal fees with nothing to show for it at the end. Still, $80k is a lot. Worth kicking the tires on the facts just to find out how this wasn’t picked up at closing, and perhaps worth getting a bit of professional advice about the options, pros and cons, etc.

FWIW, suing an attorney for malpractice is far more difficult than suing a doctor/hospital for malpractice. While there are clearly examples of a client successfully suing an attorney, there a significant likelihood it will just be an additional waste of time and effort. Your best recourse, though no financial, may be to steer friends and acquaintances away from this attorney.

It’s just a question of whether you have the money and patience to deal with all the tricks that a lawyer will throw in your path should you choose to go that route (I’m not kidding when I said our lawyer basically dared us to sue him). $80k is a lot to have to spend on matters that should have been picked up before closing.
Worth a brief chat with a good attorney to discuss options. this is not my area of law, but can’t see going after the seller’s contractors as (and don’t rely on this as legal advice)
I can’t see what their duty to you would be. But yes, worth at least finding out from your attorney what the eff happened (start out nicely and see where it goes), and also take a close look at title insurance — what does it guaranty, with what date as a trigger, etc. My understanding — and again, this is not my area — is title co also ought to have taken a quick follow up look right before closing. And, quite frankly, if you have an attorney who thinks you really have an $80k claim, worth going after them both — let them point fingers at each other but, in the end, they both have insurance. If there is validity to the claim, you ought to recover something — but this is only worth pursuing if the likely recovery is well over your cost in pursuing it. Do not throw more money at this just for a spite victory.

We had the same problem (not with Landmarks, but just a host of other violations that closing attorney never bothered to look up) – cost us thousands and thousands, six years later, we’re still dealing with it all. Tried speaking to title co, title co blamed attorney, attorney told us we’d have to sue him and basically, good luck to us as “laymen” suing an attorney. So …whilst I hope you have more luck than we did, I fear you might have to — very unjustly — bite the bullet. Lesson learned for next time, never trust your attorney and double check everything yourself as well. 🙁

Luckily, you didn’t have to live next door paying rent or having just boughten while the developer illegally did his noisy work, like myself. The Brooklyn Commisioners are clueless and the buildings and transportation people could care less about the people actually living here who have to listen to drills and saws Monday- Sunday as developers prepare other homes to sell. Wait until you experience that in your new home.
