Real estate lawyer needed/ re: Neighbor Construction
Hello, we are looking for an experienced Brooklyn lawyer/firm who understands the complex issues of living next door to a building doing extensive construction. We live in an attached 2 family townhouse. The building next door to us (We share a common wall) sold and is now beginning a gut renovated. The home had not been maintained in decades, so this will be an extensive 1-2 year project including basement excavation, extension build-out, and significant exterior/structural work.(ie. adding new floors) This construction will deeply impact the health of our building as well as the obvious quality of life concerns. Any recommendations would be very appreciated. Thank you.

You have to preempt. If the developers are upstanding and following good practice, they’ll not only have the answers for you, but agree that they themselves would have done the same.

I thought the same. Seems realistic though maybe a tad preemptive.
Keep in mind, us lay people often don’t know things and often don’t have the resources to deal with problems once they arise and it is often better from a time and expense point of view to stop it before it starts. Look on another post here, mpm333, and we realize had that person had the power of knowledge and understood what the neighbor’s contractor should be doing and had the op checked the contractor’s license, permits, and insurance, etc, none of this might have happen.
In commercial, when the neighbors are about to undertake something like this, there is someone in the building next to the proposed construction site who either already knows all of the answers or is raising all of the concerns op is raising. If they are not, they, who would be someone in building management, are not doing their job.

Have they begun work? Do they have a permit? I’d be very surprised if the DOB doesn’t require them to get a signed agreement with you concerning the construction conditions as a requirement to get their permit.

I don’t have a lawyer to refer you to but I’m guessing any experienced RE broker who specializes in Brooklyn brownstones will know one. You might also want to google “party wall agreement”. In the UK, with its many period row houses, it is standard for both owners to sign such an agreement. Not sure they exist in the US but you may get some useful pointers from reading up about them. Also, call your home insurance broker.
