Purchasing a home to live in with renters that won't leave
I entered into a contract to purchase a house in upstate NY broom swept and vacant from a seller that had renters on a month to month lease. Renters won’t leave, seller went to court for eviction has been postponed twice, now renter has applied for ERAP. My closing was in Feb, lost out on rate lock, have to re-apply for mortgage and my down payment is still in seller’s escrow. Can I sue either seller or renter? What can I do to purchase house and occupy it?

The seller will not close without an acknowledgement that the buyer has waived the requirement to deliver it vacant. Assuming the seller has a basically competent Attorney.
A discount in price or an escrow to cover costs of getting it vacant ?
But if the buyer needs to get a conventional Bank Mortgage, the Bank will not close unless they can see where the buyer / owner occupant is going to live. Owner occupancy is a requirement of all conventional mortgages.

resident2: what would happen if they allowed it to close with the tenant in place? what recourse might they have? with the old owner? never mind the nightmare of getting rid of a tenant who may simply stop paying rent.

You have two choices: Get your deposit back & give up the contract, walk away.
Or: insist that the seller deliver it vacant & only close on it when it is vacant. If it takes the seller another 6 months to get it vacant, you still have a contract for a “good Price”. Interest rates will go up a bit, but not enough to out-way the lower price? Keep looking at other properties & if something better comes along, you have options.

In my experience, from stories i have heard, when friends enter into landlord/tenant relationships things do not go well. They can become friends after but by then the boundaries are set and the business side of the relationship is clear. It is the same with hiring friends.
And what ceci says, it is worth exploring. If you do not have to move into this house right away and can wait a year, why not proceed and then go after seller for breach.
I am not a lawyer and i do not know if what i just said above is possible. There are others on here who will know.

Contract did say deliver house vacant. Sellers and renters were friends so they thought it would be easy for renter to leave. Would walk away if anything else was available. This house was listed before market skyrocketed so the price is really good. Hate to walk but I may have to.

Contact your real estate attorney!! I’m sure u have contingencies which include your abilty to secure financing and that property will be delivered vacant. If that is in your contract, you can walk away!!! You can’t sue renter; they must be evicted!!! I take you haven’t closed, you might want to consider this purchasing this headache!!!! Sorry, i just reread. Vacant. Someone on here can tell you if you can sue the owner. I bet you can if they wrote this in the contract. I do not know if it is worth it in this case but most people i know who have businesses do everything they can to avoid ending up on EITHER end of a lawsuit. Maybe you can recover the difference in the interest rate? You should really speak to an attorney.

Did anyone make a promise that the property would be delivered vacate? Sometimes we see that in real estate listings though in this environment i can not see how that person could make a claim like that.
