NYS OIL BASE PAINT VOC RESTRICTION EFFECTIVE JULY 1, 2022

this past two weeks, i have heard varying stories about a new oil base paint voc restriction. one paint store manager said ben moore will not ship any oil base paint to nyc even though quarts are ok. another man told me it is nyc only and nassau still allows oil paints. and my local store told me “Ben Moore no longer makes oil base paints”. the first two statements have a variety of truth. the last is false.

we went through this in 2004 with a variety of stories as to what was going on and most of the stories made it all worse than it was.

i just called ben moore. Ben Moore is still making oil base paints (i use super spec). the VOC restriction is based on total VOC’s coming out of a can and since a gallon of oil based paint puts out more voc’s than a quart does, they can still ship quarts of paint to NYS. they cannot ship gallons to NYS.

i am going to my local store to see if they will carry quarts for me. contractors do not buy quarts of anything as it costs to much. i am going to ask them if they can discount them a little and i am going to a sk them if they will discount them for a wider customer base, if people buy 4 quarts as if they were buying a gallon. i will report back if they say they will.

stock remaining on shelves can continue to be sold.

Ben moore has notified me that their super spec cp22, which is urethane type paint in gloss, still meets the voc requirements. Cp22 can be mixed to any color. It is a direct to metal product. Unfortunately the semi gloss and low lustre version do not meet voc. I have used this product and it is just like the super spec paint. Just as durable.

Quarts are ok per code. Problem is that is very expensive that way.

I get Oil Based Rustoleum in quarts from Amazon to paint my fencing. I think manufacturers will sell them to painting contractors and the VOC issues has come a long way but it still stinks and is bad for your lungs.

Btw, when we went through this in 04, i had a project in lower manhattan and they had enacted voc restrictions. I went to the janovic on spring st and that was where i got all of the misinformation about the requirements at that time. Even though we think they were a better store, no one had felt the need to explain it to the employees. And they were at that time already owned by ben moore.

Btw, i was in the spring street store in the early 2000’s and was at the counter asking questions and a man who had come from what i think was a staircase on the 6th ave side of the store heard my questions. He wore a tie and looked like management and was probably in his 50’s. He answered my questions and began to walk off. I was perplexed that some guy who looked like an accountant had the answers and asked the clerk who he was, his position. The clerk said if you want to know, call him back and ask him. So i did. The man was a janovic. I think he said he was great grandson of the founder. It felt like meeting living history.

I wonder if Amazon might continue to ship this to NYC? They sell lots of things that aren’t authorized, like plumbing fixtures that don’t meet NYC regulations.

Jeremy. I did all of my steam pipes here with high temp spray primers and paints. Cannot recall brand. A few years back, i had a painter here putting latex matt on the walls. He decided to do me a “favor” and paint the risers. I was pissed but said nothing. 5 or so years later, all is ok. I suppose only because cooked on over the proper paint

All this belies the fact that even the best customer service rep cannot tell me how ben moore intends to get gallons of oil base paint onto retail shelves in ny state.

Benjamin Moore’s phone support for technical paint questions was quickly responsive and very good when I called a couple times this year. I was looking for an Advance primer substitute because they stopped making it, and I needed something that could handle 240 degree heat to ensure no discoloration on exposed steam pipes and radiators in apartments. I find their store staff to be generally eager to help, but not usually as informed. Low stock due to supply chain issues has been a problem for them as well as so many other building material suppliers

so i just called Fine paints of Europe. Spoke to Charlie. he told me they can still sell their oil product all over except LA County. he said they have been dealing with these california regs for years and the way around it is by selling smaller containers of their product. he also told me that they have “sign enamel” which is made for signs but is the same as hollandac and as such is not subject to the VOC regs. (except in LA).

for those who wonder what the issue is about using water base paints, it is that it does not sand out as nicely. it moves around and binds the sand paper. to make a smooth finish with a brush we have to sand and coat until we get it where we want it.

I only know what i am told from a customer service rep named rich at ben moore. Since writing this post, i did some googling and there are all sorts of varying stories out there. jimmy, i took photos of the metal darkening agents they carry at abbot. you were looking for them about 2 mos back. i will try to post. they have about a half dozen “patinas” there.
