NYC DOB violation

Wondering if any experts here know what would NYC DOB inspector do when they come do the construction and electrical inspection for a job filing, and found out other violations unrelated to the job, such as illegal conversion in the basement? Can landlord deny access to certain parts in the house once they are inside, or block their view?

Sktomy: It depends on the inspector. I have had situations where the plumbing inspector has come to inspect work on the 5 th floor where the permit was issued and has requested access to the basement to check compliance that risers whether gas, sanitary or vents have not been altered during the 5th floor renovation. It is more common that a electrical inspector will request access to the basement due to the location of the meters and disconnect switches. they want to make sure the size of wiring running to a new circuit panel on the worked on floor is adequate and comparable to the load requirements of the disconnect switch / main breaker. If a inspector is inspecting the basement and notes a branch line coming off a gas riser he may ask to trace the gas line to see where it terminates or a electrical inspector sees something that is not electrically complaint he may also investigate further. If there are areas that are blocked off by a locked door or wall a p erson can just claim ignorance and say you do not have the key or access to said area. Sometimes this works but on occasion the inspector will reschedule a further visit when access is available

Advanced Build Co, understood that cannot deny the said inspector from wanting to access the area where job was done pertaining to the open filing/permits, what about other areas where no job was done pertaining to the open filing/permits?

Once there are open filings / permits on the Lot / Block number that pertain to electrical or plumbing you cannot deny the said inspector from wanting to access the basement if the plumbing or gas risers terminate in the basement or the electrical panels, meters or disconnect switches are located in the basement. With a construction permit they may also request access to the basement area. Specific inspectors often do not issue violations to deficiencies outside of their specific inspection but are know to note the violations and pass them on the the relative DOB departments for future inspections / investigation

Agree w/ Maggie entirely.

Don’t even attempt to bribe them nowadays unless you, or your contractor know the inspector well. Back in the day this was the only way you got things done. Don’t get me wrong, it still happens all the time, but inspectors are very cautious. I would say 75% of the time, the inspector is just looking at what they are there for, and the other 25% they are looking at everything.

i would say the likelihood of them reviewing items outside the scope of their inspection on any given day depends on 1) proximity of the unrelated potential violation to the work being inspection, 2) time of the month (always seems like inspectors who show up at the end of the month issue more violations, but i don’t have data to back that up), 3) attitude of the individual inspector, 4) attitude of owner (or contractor) regarding the inspector’s presence (be nice), 5) existence of other open violations on the property

Technically they have the ability to look at everything, but every inspector is different. I have had inspectors come in for barely a few minutes and leave while another issued a violation for failure to upkeep their entrance way and another cleared out a sea of boxes to discover and write up an illegal bathroom.
