NYC code for property line fence responsibility?
I feel like I once saw a NYC code or rule that said you can ask your neighbor to pay for 20% of a fence if it’s on the property line. Has anyone seen that, or is it just part of NYS law?

Good luck getting your neighbor to pay for anything! As 850 says, get a survey to determine precisely where the fence is relative to the property line. Attempting to share a fence (or anything) with a neighbor is perilous. If you build a fence always put in on your property, do not attempt to straddle the property line.

A partition fence is one right on the boundary line. A partition fence is synonymous with a boundary fence.

i am wondering what the definition of a “partition fence” is in the code that Leeb posted. the use of that term in the same paragraph as “retaining wall” and other “site structures” makes me think that a “partition fence” might be more than just a simple wood or vinyl fence but may be something more structural in nature, a brick wall with a footing that must be maintained for he safety of nearby persons and for that reason comes under the regulation of the DOB as does a structural retaining wall. at this point i am taking a guess but if this were put before me at a building i were working as part of my job, i would be digging deeper until i had the answer (even if there were a chance i were wrong; that is how we prevent these mistakes in buildings – by questioning our own thoughts or work all the time until they are proven).
Definitions used by the city in these codes are key to what they are addressing.

This is one of those things it’s NOT worth hagling over to keep friendly neighbors.
DO NOT BUILD THE FENCE WITHOUT A SURVEY.
Someone is gonna have to pay for a survey (around $700) or you are asking for trouble.. NOTHING is simple for a home owner with a common ACTIVE property line.
After the fence is built it’s best to have a single owner. That way their will be no dispute over maintenance…
ALERT THE NEIGHBOR that you intend to build the fence 1” into your property and DOCUMENT with the next door neighbor via certified letter.
