New NYC Smoking Policy Guidelines Effective 8/28/18

According to a new NYC law, effective August 28, 2018, any building greater than three (3) units will be subject to the following guidelines pertaining to smoking:

1) Smoking of e-cigarettes or any cigarettes, cigars, etc. is now prohibited in any common areas of all residential buildings.

2) Boards are now to mandate a Smoking Policy that will cover the Owner’s policy on smoking in any and all indoor and outdoor common areas on premises. These outdoor areas take rooftops, balconies, terraces, courtyards, etc. into consideration.

The policy will not be binding on any rent controlled or rent stabilized tenant who is in possession prior to the adoption of the initial smoking policy (or any family member who succeeds to the rights of such tenant).

This Smoking Policy must be either handed out yearly to each resident or posted in a prominent area of the building. For all transfers (sales or sublets) this information now must be placed in the agreement.

In a condominium, the Board of Managers must incorporate the policy into the by-laws or house rules. In a cooperative, the board of directors must include the policy in the by-laws or house rules.

It is important to note that although the Smoking Policy is required, it is not required to have a policy in place for smoking inside individual apartments.
