Neighbor's facade falling apart

Our neighbor’s facade borders on our backyard, and it is currently in total disrepair. Our landscapers are actually afraid to do work in our backyard because the brick and the masonry rocks at the footing is so loose, and in such need of mortar and repointing, that they pose a working hazard. So we’re now having delays to our project. I found the neighbor’s name through the DOB, and I stopped by his store to discuss it, and he brushed me off. I also sent him an email and a certified letter with photos, and called him, asking him to at least look at the wall (he needs access to my backyard) and to eventually repair it. No response. Is the DOB the next resort? What are my options, since he clearly doesn’t care? I’d like to be able to renovate and use my backyard this spring/summer, but two different contractors have told me that the wall needs to be repaired first.

Be aware, when DOB responds to inspect they could potentially put a partial vacate order on your backyard if the condition of the wall warrants it. This could get messy. Once a partial vacate is issued you would be unable to use your backyard until the wall is repaired and the property is re-inspected. I don’t know what to advise other than to keep pushing with the owner. Does he occupy the building, or are there tenants? I only ask because if they are tenants they could be useful resources in trying to get him to respond.

If it’s a hazardous condition, go to 311 & get a hazardous condition violation issued – they have to be dealt w/ immediately.
