Neighborly behavior/back yard

Was wondering what the neighborly etiquette is when installing a back yard fence. Currently I have a chain link fence shared with my neighbors on both my left and right. If I wanted to install a privacy fence, do I need to remove the existing chain link fence or install another fence within the borders of the chain link? How do I know who the owner of the existing fence is – me or my neighbor? Any advice on how to handle this? Thanks so much for your input.

Talk with your neighbors for a solution. If they are okay with removing the fence, then you can continue your work. If they disagree, then it is better to install the new fence within the border. Tell them that privacy fence will be useful for both you and your neighbor.. They may possibly agree with it.

AFAIK there’s no actual law in NYC requiring the “good” side of a fence to face outwards. It might, however, be the ccourteous thing to do

I think it all depends on what you want and the length x height of your fence. I was pricing cedar, 1×4 at 6ft high, which came to around 1100 linear feet, and was roughly $1600-2000 for wood. Plus labor. You can also go with panels from a big box store. Or semi-custom panels from specialty fencing stores (there is one on 13th and 3rd, or thereabout). They priced me at $5-6k some months back.

Thanks, Daveinbedstuy – we are pretty certain that the current chain link fence is not on the shared line but instead the left line is on the owners and the right side is on the neighbor’s to the right, and it continues this way down the block. So I believe the left side I can make face me, while the right side, I cannot and will have to board it on my side as well as the neighbor’s if I wanted to have both facing me. I have pretty reasonable neighbors and we decided to do exactly that in the spring.

If it’s on your property you can take it down. Just be sure that it is. Which is what a survey will tell you. I’m not sure about the law in NYC but in manu places, the nicer face side of a fence has to face the neighbor’s property. Getting a board on board or solid board fence solves that issue as both sides are the same.

Thanks everyone was sharing your experience. I haven’t had the survey done at time of purchase, but think that maybe I should. That said, I looked closely at the current chain link fence, and the side on the left is clearly on my property as is in front of my wall, the fence on the right is on the side of the right neighbor. So if the chain link fence is on my side, can I remove it and have a new cedar fence ‘face’ me (since on my side)? I tried to talk to my neighbour, but 4 attempts to ring the door bell, numerous calls, messages with his tenants, all remained unanswered. I feel that with the winter imminent, maybe I will wait for the spring to do this.

I have a brownstone in Fort Greene. I contacted my neighbor about putting up a cedar fence to replace the ugly chain linkthat had been there for 30 years–she was so happy, she paid for part of it, and the flat part of the fence faces me! Did you have a survey done when you renovated? We used the one we filed with the DOB to determine the boundaries. The survey we did was $700 and worth it because it ends up that part of he chain link was cutting into our property, and our new fence runs exactly on the property line, and our neighbor is fine with that, because it’s the legit line.

I have replaced many fences in Brooklyn. Typically the face (including chain link is facing the owners side. If the fence matches the fence along a rear property line that can help identify ownership. Finally, look towards the house and up at the cornice, that is usually a good way to see where the homes meet and you can tell whose property it’s on. ALWAYS contact your neighbor first, and if there is a disagreement, just build in front of it. This is how I work without a survey.

I built a 6 foot wooden privacy fence. I simply knocked on my neighbors doors and asked if they had any issues. They were very nice about it. on one side the chain link fence was falling over so we removed it. on the other side the fence was intact and my neighbor had been leaning gardening stuff up against it so we left it there. At the far end of the yard we removed a crumbling cinderblock wall as well as a dead tree that was half way between mine and my neighbors property. I had a survey from when i purchased the property so i did not need to have a new one done. one thing i learned is that a fence has a front and a back (depending on the type you are building) and the rule, technically, is that the back of the fence (where posts and supports are visible) should face inward, and the exterior (the flat side) is supposed to face your neighbors. But, because we spoke to the neighbors we did it the other way around and nobody had an issue with this. Or you can install a double sided fence where the posts are hidden between two flat faces. this is of course twice as much money and will take up a few extra inches of space all the way around. If your neighbor does a lot of gardening you may want to be considerate of the amount of shade your fence will throw on their plants.

specifying an architectural survey will be more useful as they list actual current items such as telephone poles, existing fences, etc. Then you have it for the future and you don’t have to worry about stakes being removed. The last time I had one done, it was around $500 (I didn’t need to show sewer lines, so that saved me a few bucks). It was also five years ago, the price has probably gone up a bit. In many neighborhoods in Brooklyn the chain-link fence is the original boundary fence in which case do not touch it; build your fence on your side of it and do not let your neighbor take it away just because you have built a privacy fence.
You should get a survey if you want to build a new fence, it can cause all manner of future title issues if you put your fence in the wrong place.

The only way to be certain of who owns the chain link fence is to hire someone to survey your property and have them install stakes to identify the property line on site. Survey + stakes cost me +/-$950 recently.

First talk to your neighbors to see how they feel about a new fence. It’s probably best to remove the chain link but why don’t you solicit their opinions?
