Neighbor Sprays Weed Killer in My Yard

English Ivy- what is consensus (and legality) of neighbor spraying my yard with weed killer over my 6 foot fence trying to kill ivy. Instead he killed 1/4 of my 18 foot Japanese Maple and two shrubs. Also have pets and small children in backyard. A call or email could have avoided this.

Well everyone believe it or not the owner of New Start Development Alfred Thompson wrote me a letter again admitting spraying weed killer and that he will continue to do so. Trying with NYC DEP and Health Services

That’s really not kosher. I would tell your neighbor you’ll help him out by ripping out any ivy that wanders into your yard but express firmly and clearly that he cannot spray your property. I would also ask for compensation for the dead plants.

do you want to know? in another life and in another state, I was a licensed herbicide and pesticide applicator (no lie, I was a property superintendent after college). we were told that if we got any chemical on another’s property (in other words even it the wind blew it there) we could get in serious trouble (legal). I would bet the new York city health dept would go nuts over this.

All that your neighbor is legally able to do is: cut anything that grows onto their side of the boundary. They cannot literally cross the line.
They have absolutely no right to spray toxic chemicals onto or into your yard.
Take good pictures & keep a diary. Write a very firm letter stating that their actions are illegal and that you will be forwarding the bill from a landscaper for the cost of replacing & repairing the plantings that they have killed.
Get a quote. Not just for the cost of replacement plants & soil, because we all know as gardeners you can not bill for the years of evolution & growth of your plantings. Nor should your time go for free to replant etc.
If it continues, call the Police. It is a form trespassing and vandalism.
These kinds of incidents were easier to handle when there were block associations and neighbors all spoke to each other.
It is always best to have open an open communication relationship with neighbors. Even if it is only verbal.

Are you friendly with said neighbor? Did they have access to your phone # or email address? Any action that could potentially harm my children really make it difficult for me to think rationally so I think I will end with that for now.
