My Top Floor Tenants Children Are Tormenting My 2nd Floor Tenants

Not sure what to do and would love to ask the generous hive mind of Brownstoner. My 3rd floor tenants have a totally rambunctious and super loud three year old that’s pretty much so loud and so energetic that it keeps all of us below them pretty stressed out. Now my 2nd floor tenants came to me asking for any kind of help as it is becoming impossible for them. I am thinking of offering them a rent concession as I feel for them but I also need to talk to the 3rd floor tenants. Any idea how I approach this? I can buy carpets but they need to be a bit stricter with their child. Anything else we should do?

Read your lease. Are you a 3 family or rent controlled/stabilized? Add a carpeting clause. Talk to the tenants with the kid. Then issue a warning that if the complaints keep coming that you may be forced to voice their lease and ask them to move. If they don’t comply they are jerks and need to go find a new place to live.

Give notice – matter of factly, to the 3rd floor tenant, that there have been several noise complaints against them. Be helpful with suggestions if asked, but ultimately, it’s on them to correct the behavior.

I suggest you address this in person with your 3rd floor tenant. I’ve had this issue multiple times, and while it doesn’t disappear, most people will consider some times, or specific limits/changes to behavior. I do have the 80/20 carpet rule in my lease and enforce it when necessary, as in a case like this. Maybe also look at the “long view” for the duration of their lease…is this seasonal because the child isn’t playing outside in the winter? Do the people in the other apartments work from home and are more exposed to the 3rd floor noise? This is landlording, and until you can turnover the apartment, maybe you can think up some creative and diplomatic ways to mitigate it. Good luck!

Do you have a carpeting rule in your lease? Carpeting should largely take care of the problem and if it’s in the lease, the tenants pay for it.
Do this instead of offering any concessions.

If the parents/guardians of the child on the 3rd floor is completely oblivious to their child running , jumping shrieking whatever in a confined space with other people in the same building the chances are they do not want hear from you or anyone else telling them how to manage their child.
Just do not renew their lease when it comes up, but do not say it is due to their child. It is because you “brother”, “sister” whoever needs the apartment…
